Kochi High Court Halts Commercial Kiosk Construction on Queen's Walkway
The High Court in Kochi has issued an interim stay on the construction and installation of commercial kiosks along the Queen's Walkway, a key recreational space in front of the Tritvam Apartment Complex and adjacent to Goshree Chathiyath Road. Residents Challenge Gida's Commercialization Plan
Justice Bechu Kurian Thomas granted the interim order after hearing a petition submitted by the Tritvam Apartment Owners' Association and two individual residents. The petitioners strongly opposed the Goshree Islands Development Authority's proposal to establish approximately 20 commercial kiosks along the walkway. They argued that this development would fundamentally alter the area's character and pose multiple risks to the community.
The Queen's Walkway was originally developed as a dedicated recreational and wellness space through a collaboration between Gida and Cochin Smart Mission Ltd. Located within a premium residential zone that houses nearly 8,000 residents, the walkway serves as a vital public amenity for leisure and health activities.
Key Concerns Raised by Petitioners
The residents presented several compelling arguments against the kiosk project:
- Residential Character Preservation: The installation of commercial establishments would disrupt the peaceful residential nature of the zone.
- Traffic Congestion: Increased commercial activity would likely worsen existing traffic problems in the area.
- Health and Safety Risks: The kiosks could introduce hygiene issues and safety hazards for pedestrians.
- Fire Hazards: Additional structures might increase fire risks in a densely populated residential area.

The petitioners emphasized that they had previously submitted detailed representations to the authorities but received no substantive response, which compelled them to seek judicial intervention through the High Court.
Legal Proceedings and Court's Rationale
During the hearing, Gida and its secretary opposed the interim relief, referencing an October 2022 order from a single bench that had vacated an earlier stay and permitted the project to proceed. However, Justice Thomas observed that allowing construction to continue while the petition was pending could render the entire legal challenge infructuous, effectively undermining the judicial process.
The court therefore stayed the installation of kiosks and adjourned the case to March 23 for further hearing, ensuring that the matter would be thoroughly examined before any irreversible development occurred.
