Kochi High Court Mandates Urgent Action on Hazardous Metro Pillar Road Conditions
The High Court of Kerala has issued a decisive order requiring the Kochi Corporation, the state government, and Kochi Metro Rail Ltd (KMRL) to immediately identify, level, and permanently rectify all dangerous road surface protrusions and uneven sections surrounding Metro pillars throughout Kochi city. This directive comes in response to a Public Interest Litigation (PIL) that highlighted severe safety risks to motorists.
PIL Highlights Grave Road Safety Concerns
The bench, comprising Chief Justice Soumen Sen and Justice V M Syam Kumar, acted on a PIL filed by Pauly Vadakkan from Kadavanthra in Kochi. The petitioner argued that road surface irregularities around Metro pillars have created protrusions approximately 3 to 4 inches above road level. These hazards are situated along busy traffic lanes and are particularly difficult for motorists to spot, especially during nighttime, posing a significant threat to road users, with two-wheeler riders being especially vulnerable.
Court Orders Comprehensive Safety Measures and Audit
In light of these submissions, the High Court has mandated several critical actions:
- The Kochi Corporation must appoint a technical committee or expert agency to conduct a comprehensive safety audit of all roads along the Metro rail corridor. A detailed report must be submitted by June 11.
- The corporation secretary is required to convene an urgent meeting with the district collector, KMRL, and the Kerala Road Safety Authority to coordinate efforts for road restoration.
- Authorities must install adequate and effective safety measures at all identified hazardous locations. These include high-visibility warning signage, reflective road markers, rumble strips, and impact-absorbing protective installations around Metro pillars.
Accident-Prone Locations and Media Reports Cited
The petitioner identified several critical accident-prone areas where these protrusions are most dangerous. These include:
- Sahodaran Ayyappan Road, particularly near Manorama Junction and the Elamkulam stretch
- Kalamassery
- Edappally, near Changampuzha Park
- Kacherippady-Kaloor
- MG Road
Referring to multiple media reports, the petitioner described the protrusions as akin to hitting an invisible wall, leading to vehicles overturning and numerous near-miss accidents. The lack of warning signs and reflective indicators has exacerbated the risk, making these areas particularly perilous for all road users.
Evidence of Accidents and Ongoing Risks
To underscore the urgency of the situation, the petitioner cited four specific accidents that occurred directly due to these road protrusions. These incidents highlight the immediate and tangible danger posed by the neglected infrastructure, reinforcing the court's call for swift and effective intervention to prevent further harm and ensure public safety on Kochi's roads.
