Kanpur Court Orders Release of Lamborghini Following Accident Case Resolution

In a significant development in the Kanpur Lamborghini case, the high-value sports car was officially released from the Gwaltoli police station late last night. The release came in strict compliance with a judicial order issued by the court of Chief Judicial Magistrate Suraj Mishra, which had mandated specific conditions for the vehicle's return to its owner.

Court Mandates Substantial Financial Guarantee for Vehicle Release

The court's Friday ruling established that a substantial surety of Rs 8.30 crore had to be furnished alongside a formal undertaking before the Lamborghini could be released from police custody. This luxury vehicle, valued at multiple crores of rupees, had been stationed at the Gwaltoli police station since its involvement in a road accident earlier this year.

Following the court's directive, the Lamborghini was carefully transported from the police station via truck, marking the conclusion of its extended stay in official custody. Legal experts note that such substantial surety amounts are typically determined based on the court's discretion regarding the vehicle's market value in similar cases.

Background of the February Accident Incident

The incident traces back to February 7th, when Shivam Mishra, son of prominent tobacco businessman KK Mishra and resident of Arya Nagar, was traveling in the Lamborghini with his driver Mohan M. At the Bhairoghaat intersection, the vehicle was involved in an accident that resulted in injuries to Taufiq Ahmad, a resident of Chamanganj Ghosiyana.

In the aftermath of the collision, driver Mohan M voluntarily surrendered before the court. Police investigations subsequently submitted a report clarifying that the driver was not formally accused in the case. However, authorities later arrested Shivam Mishra for alleged non-cooperation with the investigation and failure to respond to official notices.

Judicial Proceedings and Legal Arguments

The court examined Mishra's arrest and ultimately deemed it improper, declining to take him into judicial custody. Instead, he was released on a personal bond of Rs 20,000. Following this development, an application was formally filed in court on behalf of Shivam Mishra specifically requesting the release of the impounded Lamborghini.

Legal representation was arranged with attorney Sunil Kumar appointed to pursue the case on Mishra's behalf. The court systematically requested both the technical examination report and the comprehensive police report related to the incident. After thorough review of both documents, the judicial authority accepted the release application, paving the way for the vehicle's return.

Legal Perspective on Vehicle Release Procedures

Advocate Shivakant provided insight into the legal framework governing such cases, explaining that "in circumstances involving vehicle impoundment, the court typically establishes a surety amount as a condition for releasing the vehicle. While the specific amount depends on judicial discretion, it is commonly determined to be equivalent to the vehicle's market value."

This case highlights the intricate legal processes involved when high-value assets become subject to judicial proceedings following traffic incidents. The substantial surety requirement reflects both the vehicle's significant worth and the court's measured approach to balancing legal requirements with property rights.
