Kanpur Court Denies Bail to Dowry Death Accused After Lengthy Absconding Period
In a significant ruling, the bail application of Sulabh Mishra, also known as Shyam Babu, accused in a 2012 dowry death case, was firmly rejected by the Additional Sessions Judge in Courtroom Number 20 of Kanpur Nagar on Tuesday. According to Sanjay Kumar Jha, the Additional District Government Counsel, Mishra, a resident of Jamu village under Bidhano police station, had been evading law enforcement for an astonishing 12 years following the alleged incident. His arrest in 2024 came only after authorities attached his property, a move that led to his apprehension along with other co-accused individuals. Notably, the court had previously dismissed bail applications for other defendants in this same case, highlighting the gravity of the charges.
Details of the Alleged Dowry Death
The case dates back to November 23, 2010, when the complainant married his daughter, Uma Devi, to Sulabh Mishra. As per the complaint, the bride was sent with dowry and gifts deemed appropriate for the family's social status. However, Mishra and his family reportedly expressed dissatisfaction with the offerings, demanding a motorcycle and subjecting Uma to severe torture and physical abuse to enforce this demand. During a visit to her parental home, Uma confided about the harassment she was enduring.
Tragically, on January 17, 2012, the situation escalated when Mishra and his family members allegedly killed Uma. In an attempt to disguise the crime, they hanged her body to simulate a suicide. The post-mortem report confirmed the cause of death as "combined effect of asphyxia varicose congestion due to ante mortem hanging," supporting the prosecution's claim of foul play.
Court Proceedings and Bail Plea Arguments
During the bail hearing, Mishra's defense argued that he had no prior criminal history and had been under judicial custody for the past two years. He assured the court that he would not misuse bail and would attend all future hearings diligently.
