A case of instant triple talaq has been registered in Chamba district of Himachal Pradesh, police said on Tuesday. The complaint was filed by a woman who alleged that her husband pronounced “talaq” three times in the presence of her brother and a neighbor before forcing her to leave the house.
Details of the Complaint
According to the complaint, the woman married Rustam Ali in 2020. On June 28, 2026, her husband allegedly uttered the word “talaq” thrice in front of her brother, Liaqat Ali, and neighbor Anju. He then forced her to leave the house. The woman approached the police after being unable to return home.
Station House Officer (SHO) of Chamba police station, Inspector Rajesh Kumar, confirmed that a case has been registered under Section 4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, which criminalizes instant triple talaq. The Act provides for a punishment of up to three years imprisonment for the offender.
Legal Context
The Muslim Women (Protection of Rights on Marriage) Act, 2019, was enacted by the Indian Parliament to declare instant triple talaq (talaq-e-biddat) void and illegal. The law also entitles the woman to maintenance and custody of children. In this case, the woman has also sought maintenance and protection.
“We have registered the case based on the complaint and are investigating the matter,” said Inspector Rajesh Kumar. “The woman has been provided with necessary support and legal aid.”
Reaction and Impact
The case has sparked discussions about the prevalence of instant triple talaq despite the law. Activists have called for stricter implementation and awareness campaigns. “This is a clear violation of the law and the woman’s rights. The police must act swiftly,” said local women’s rights activist Sunita Sharma.
The husband, Rustam Ali, has not been arrested yet as investigations are ongoing. Police have recorded statements of the complainant and witnesses. Further action will be taken based on the evidence gathered.
