The Nagpur bench of the Bombay High Court has issued a significant directive to the Nagpur Municipal Corporation (NMC), ordering the civic administration to immediately halt the finalization of lease distribution processes for the contentious Tajbagh land. This judicial intervention comes in response to a petition filed by the Hazrat Baba Tajuddin Trust, which has raised serious objections to the NMC's recent actions regarding the 84-acre property.

Trust Challenges Government Land Reclassification

The Hazrat Baba Tajuddin Trust approached the court after discovering that the Nagpur Municipal Corporation had initiated procedures to distribute ownership leases for the Tajbagh land. The trust has vehemently contested the Maharashtra government's reclassification of what it claims is private property into a slum area designated as government land. According to trust representatives, this reclassification represents an illegal seizure of over 43 acres of their territory for public housing initiatives, completely disregarding established ownership rights that have been in place for generations.

The trust's legal representatives argued before the court that the civic administration's move was both arbitrary and unilateral in nature. They emphasized that the land, situated within the Tajbagh premises associated with the revered shrine of Hazrat Baba Tajuddin, constitutes private property belonging to the trust. Any interference by municipal authorities, they contend, violates fundamental legal norms governing property ownership rights in India.

Contradictions in Development Plans

Adding complexity to the situation, the trust highlighted that state-funded beautification work for the second phase of development on the same Tajbagh land has already received official approval. This raises significant questions about the timing and underlying intent behind the Nagpur Municipal Corporation's sudden push to distribute ownership leases. The original vision for the property involved a multi-phase beautification project designed to enhance the area for visiting pilgrims while simultaneously rehabilitating existing residents in a thoughtful manner.

Secretary Taj Ahmad Raja of the Hazrat Baba Tajuddin Trust made serious allegations against municipal authorities, claiming that the NMC, in coordination with its slum department, has begun preparations for distributing pattas (ownership rights documents) without obtaining the trust's consent or even informing them about the process. He characterized the entire procedure as "one-sided" and accused the administration of deliberately misleading local residents about the true nature of the land ownership situation.

Legal Process and Future Proceedings

The petitioners have presented a compelling case that the state government failed to conduct proper legal inquiries or consult with the trust before making declarations about the land's status. Their ultimate objective is to quash the controversial notifications to protect their property from being subdivided and distributed to the general public through what they view as an illegitimate process.

Trust chairman Pyare Jiya Khan further alleged that certain political leaders have created confusion among residents regarding the patta distribution initiative. He stated unequivocally that these individuals would not be permitted to carry out any activities within the Tajbagh trust premises without proper authorization.

The Bombay High Court has scheduled the matter for further consideration on June 19, 2026. In the interim period, the court has directed that until the next hearing date, the Nagpur Municipal Corporation shall not finalize any aspect of the lease distribution process. This judicial pause provides temporary relief to the trust while the complex legal questions surrounding property rights, government authority, and development priorities are thoroughly examined through proper legal channels.
