Allahabad High Court Stays Arrest of Suspended Jail Superintendent in Illegal Release Case
The Allahabad High Court has issued a significant order staying the arrest of suspended Banda district jail superintendent Anil Kumar Gautam. This decision comes in connection with a First Information Report (FIR) that alleges the illegal release of a Noida-based scrap mafia figure from jail, despite an active custody warrant against him.

A Division Bench comprising Justice Rajeev Mishra and Justice Satya Veer Singh passed this order on April 1, 2024. The bench was hearing a petition filed by the suspended official, who sought the quashing of the FIR and protection from arrest. While granting the stay on arrest, the court has explicitly allowed the police to proceed with their investigations into the matter.
However, the court has imposed a crucial restriction: the police are restrained from filing any investigation reports before the jurisdictional magistrate until further orders are issued. This measure ensures that the judicial process remains controlled while the petition is under consideration.

The court has formally issued notices to all respondents involved in the case, including the state government. These parties have been granted a period of six weeks to file their counter-affidavits in response to the petition. The next date for hearing has been fixed for May 27, 2024, setting a clear timeline for the legal proceedings to advance.
Background of the Controversy
The controversy stems from events involving Noida scrap mafia figure Ravindra Singh, also known as Ravi Kana. Singh had been held in Banda Jail since August 2024 in connection with a separate case. He was produced before the Chief Judicial Magistrate of Gautam Budh Nagar on a B-warrant, which is a custody warrant issued for his appearance in court.
Police allegations state that just hours after this virtual court appearance, the jail administration illegally released Kana from custody. This release was executed without any written court order and without informing the court, leading to significant legal and procedural breaches.
FIR and Immediate Actions
The unauthorized release drew strong objections from the court, prompting immediate action. An FIR was subsequently lodged on February 2, 2026, by jail chowki in-charge Anurag Pandey. The FIR was filed against three jail officials, invoking Section 260(C) of the Bharatiya Nyaya Sanhita (BNS), which pertains to offenses related to public servants and their duties.
