The bench highlighted that it is the responsibility of the concerned family court to initiate coercive measures to ensure the husband's appearance, rather than using a habeas corpus writ, which is traditionally reserved for cases involving illegal detention.
The background of the case dates back to January 2021, when a family court in Azamgarh directed the husband to provide maintenance for his wife and daughter. However, the husband failed to comply with this order, and his whereabouts became unknown, prompting the wife to file the habeas corpus petition. In her plea, she requested the court to issue a writ directing state authorities to produce her husband before the high court or the principal judge of the family court in Azamgarh, with the aim of handing over his custody to facilitate recovery of maintenance arrears.
