Himachal Pradesh High Court Dismisses Singhvi's Application in Rajya Sabha Election Petition
The Himachal Pradesh High Court, in a significant ruling on Friday, dismissed an application filed by senior Congress leader Abhishek Manu Singhvi in the ongoing Rajya Sabha election petition against Bharatiya Janata Party (BJP) MP Harsh Mahajan. Court's Rationale for Dismissing the Application
Justice Virender Singh, presiding over the case, emphasized that the burden of proof lies with the respondent, Harsh Mahajan, to defend his election. The court noted that Singhvi's application, which claimed that the proposed witnesses were frivolous and intended to delay proceedings, could not be accepted at this stage.
The court highlighted that Singhvi initially opted to lead evidence after the framing of issues, then sought time to produce documents, and ultimately chose not to produce any documents when given the opportunity. This sequence of actions undermined his argument against witness examination.
Furthermore, the court pointed out that Mahajan has proposed only 18 witnesses, with the majority based in Shimla, making the process manageable. "The matter must be viewed from the perspective of the party upon whom the onus has been placed to prove the issues," the court stated. "A party cannot be compelled or dragged by the court to lead evidence in a particular manner to prove an issue for which they bear the burden."
Next Steps in the Legal Proceedings
With the dismissal of Singhvi's application, the main election petition has been scheduled for further hearing. The court has posted the case for April 20 before the additional registrar (judicial) to fix a date for recording the evidence of Mahajan's proposed witnesses.
