Inspection Reveals Widespread Unauthorized Constructions

The FIR was lodged following a thorough inspection conducted by lekhpal Niranjan Mishra in Mukimpur Shiwara, a village located approximately 4 kilometers from the airport site. During the inspection, Mishra discovered extensive unauthorized constructions that blatantly violated the established regulations.

Mukimpur Shiwara falls within the third phase of the ambitious airport project. For this phase, the state government issued a crucial notification on April 11 of the previous year, clearly outlining the restrictions.

Notification Details and Legal Framework

Lekhpal Mishra elaborated that the notified land encompasses several villages, including Rohi, Parohi, Banwaribas, Ramner, Kishorpur, Sabota, and Mukimpur Shiwara. Under the stringent provisions of Section 11(4) of the Resettlement and Rehabilitation Scheme, 2013, no transaction or construction is permitted on such land from the date of the official notification onward.

The four accused individuals, identified as Imran, Samshu, Nasir, and Mubarak, all residents of Nangla Jahanu, have been named in the FIR. They are alleged to have been actively carrying out construction activities on plot number 235 in Mukimpur Shiwara, directly contravening the legal stipulations.

Motivation Behind Illegal Constructions

Officials involved in the case have pointed out that the Resettlement and Rehabilitation (R&R) scheme provides not only land compensation but also financial assistance for the relocation of houses. This comprehensive compensation package may be driving attempts to hastily build on the notified land, with the aim of inflating claims.

Mishra emphasized that any such fresh construction would unnecessarily increase the compensation burden on the government and, therefore, must be stopped immediately to ensure fair and lawful proceedings.

Legal Charges and Police Action

Jewar Station House Officer (SHO) Sanjay Kumar Singh confirmed that the police have registered the case under specific legal sections. The charges include Section 223 of the Bharatiya Nyaya Sanhita (BNS) for disobedience to an order duly promulgated by a public servant, and Section 329(3) for criminal trespass.

Background on Airport Land Acquisition

The Noida International Airport project has already undergone large-scale land acquisition in its earlier phases. In phase 1, the state acquired 1,334 hectares at a rate of Rs 2,100 per square meter. Phase 2 saw the acquisition of 1,365 hectares at Rs 3,100 per square meter.

The current plans involve acquiring an additional 2,053 hectares in phases 3 and 4, with a proposed rate of Rs 4,300 per square meter. This underscores the scale and economic significance of the project, making the prevention of illegal constructions critical to its timely and cost-effective execution.
