Presiding Officer Sudeep Raj Saini delivered the order on June 9, holding the driver, Devender, responsible for the collision due to rash and negligent driving.

Details of the Accident and Legal Proceedings

Parmanand Rai, a vegetable seller, was crossing a road in Najafgarh on the night of February 29, 2020, when a speeding car hit him, causing critical injuries. The tribunal based its decision on the Detailed Accident Report (DAR), Rai's testimony, medical records, and the chargesheet, all of which pointed to the driver's fault. The court assessed Rai's functional disability and loss of earning capacity at 30 percent.

Compensation Breakdown and Insurance Directive

The tribunal awarded a total compensation of Rs 23.16 lakh, covering medical expenses, loss of future income, pain and suffering, and other applicable heads. Since the offending vehicle was insured at the time of the accident, the court directed the insurance company to deposit the full amount in Rai's favor. The order underscores the legal recourse available to victims of road mishaps caused by negligent driving.
