Delhi HC Lists CBI Plea Against Kejriwal, Sisodia for May 4

The Delhi High Court on Wednesday listed the Central Bureau of Investigation's (CBI) plea challenging the discharge of former Delhi Chief Minister Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia in the excise policy case for hearing on May 4.

Justice Dinesh Kumar Sharma noted that the court was yet to receive the complete trial court record, including the latest orders passed by the lower court. Consequently, the hearing on the CBI's petition was deferred until May 4.

Background of the Case

The excise policy case pertains to alleged irregularities in the formulation and implementation of Delhi's excise policy for 2021-22. The CBI had filed a case against Kejriwal, Sisodia, and others, accusing them of corruption and criminal conspiracy. However, a trial court had earlier discharged both leaders, prompting the CBI to approach the High Court.

CBI's Arguments

The CBI has contended that the trial court's order discharging Kejriwal and Sisodia was erroneous and based on a superficial assessment of the evidence. The agency argued that there was sufficient material on record to frame charges against the accused. The CBI further stated that the discharge order would set a wrong precedent in cases of corruption.

Defense's Stand

On the other hand, the defense counsel for Kejriwal and Sisodia argued that the CBI's plea was without merit and that the trial court had correctly evaluated the evidence. They maintained that there was no prima facie case against their clients and that the discharge order was legally sound.

Next Hearing

The High Court will now hear the matter on May 4. Meanwhile, the court has directed the trial court to expedite the process of sending the complete records. Both parties are expected to present their final arguments on the next date of hearing.
