Delhi High Court Issues Restraining Order Against Sanjay Dutt-Backed Whisky Launch
The Delhi High Court has taken decisive action by restraining Cartel Bros, an entity supported by Bollywood actor Sanjay Dutt, from proceeding with the commercial launch of its proposed whisky brand, 'Glenwalk Godfather'. This order comes in response to a trademark infringement plea filed by Devans Modern Breweries, a prominent player in the beverage industry.
Trademark Infringement Allegations by Devans Modern Breweries
Devans Modern Breweries, which markets the widely recognized 'Godfather' beer and also sells spirits under the same brand, argued that Cartel Bros had dishonestly adopted the 'Godfather' mark for its new whisky product. The company emphasized that the 'Godfather' trademark enjoys a strong reputation and significant goodwill in India, supported by multiple registrations under the Trademark Act. According to Devans, the use of an identical mark for similar alcoholic beverages would constitute clear infringement and could lead to consumer confusion.
Prem Diwan, Chairman and Managing Director of Devans Modern Breweries, stated, "We have registration of 'Godfather' under the Trademark Act. We sell beer and liquor, including whisky, under the same brand." This assertion underscores the company's legal standing and commitment to protecting its intellectual property rights in a competitive market.
Court's Interim Directions and Defendant's Undertaking
After hearing detailed submissions from both parties, the court recorded an undertaking from Cartel Bros to defer the commercial launch of the 'Glenwalk Godfather' whisky until the next date of hearing, which is scheduled for April 10. In addition to this, the court issued specific directives to prevent any further promotional activities related to the disputed brand.
The court ordered Cartel Bros to refrain from issuing any fresh promotional or social media communications concerning the 'Godfather' branded product during the interim period.
