Ahmedabad Court Issues Temporary Restraint on Rebel Foods Over 'Honest' Trademark

A commercial court in Ahmedabad has issued a temporary restraining order against cloud kitchen company Rebel Foods Pvt Ltd, preventing it from using the prefix 'Honest' in its city-based delivery-focused restaurant chain, Honest Bowl. The directive was handed down on Friday following a lawsuit filed by the well-known local restaurant brand, The Honest Reveira, which alleged significant infringement of its registered trademark.

Legal Battle Over Trademark Rights

The plaintiff, Honest Reveira, initiated legal proceedings against Rebel Foods, seeking a permanent injunction and additional reliefs. These include restraints against trademark, device mark, and copyright infringement, as well as claims of unfair trade practices, dilution, and delivery-up concerning the trademark 'Honest Bowl'. Central to the dispute is the use of the prefix 'Honest' in the trade name, which the plaintiff argues violates its long-established rights.

Plaintiff's Claims and Historical Usage

Honest Reveira asserted that it has been using the trademark 'Honest' since 1976, presenting multiple registrations as evidence, including one in Class 43 for restaurant services. The brand also highlighted international registrations in several countries and reported sales figures amounting to Rs 41.9 crore. With 25-30 branches in Ahmedabad and additional outlets across India and abroad, the plaintiff emphasized its extensive market presence and reputation.

Advocate Zahid Shaikh, representing Honest Reveira, detailed that Rebel Foods had applied for the marks 'The Honest Bowl' in February 2021 and 'Honest Bowl' in May 2021, both on a 'proposed to be used' basis. Honest Reveira had formally opposed both applications before the trademark registry, signaling early concerns over potential infringement.

Defense and Court's Assessment

In response to cease-and-desist notices sent twice to Rebel Foods, the company argued that the word 'Honest' is a dictionary term and merely descriptive. However, the plaintiff countered that Rebel Foods' adoption of the word 'HONEST' and its associated imagery constituted an imitation of Honest Reveira's trade name style. This, they claimed, was designed to mislead consumers into believing the services were provided by the plaintiff, thereby causing confusion in the same market segment.

After reviewing the plaintiff's arguments, the commercial court conducted a prima facie assessment and concluded that Rebel Foods' use of 'HONEST' as a prefix was not only identical but also deceptively similar to the plaintiff's mark. The court found that this similarity was likely to cause confusion among consumers, potentially harming Honest Reveira's business interests.

Court's Directive and Future Proceedings

The court stated, 'Thus, considering the facts and circumstances of the case as well as after going through the documentary evidence produced on record by the plaintiff, it appears that the interest of the plaintiff is required to be protected to some extent, till next returnable date.' As a result, a show-cause notice has been issued to Rebel Foods, requiring a reply by April 13. This temporary restraint aims to safeguard the plaintiff's trademark rights while the legal process continues, highlighting the ongoing tensions in the competitive food delivery industry over brand identity and intellectual property.
