Mumbai Court Rejects Bail Application in High-Profile Road Rage Assault Case
In a significant legal development, the Mazgaon metropolitan magistrate's court in Mumbai on Wednesday firmly rejected the bail application of three individuals accused in a violent road rage assault case. Among the accused is Khaliq Khan, the 66-year-old father-in-law of renowned Indian cricketer Yusuf Pathan. This decision comes amidst heated arguments from the defense and detailed police investigations into the altercation that occurred over the weekend.
Defense Arguments and Court's Stance
Defense advocate Dayanand Dere presented a multifaceted argument in favor of granting bail to the accused. He emphasized that both parties involved in the incident had allegedly assaulted each other, leading to a cross-FIR being registered against the complainant and others. Dere further highlighted Khaliq Khan's status as a senior citizen, asserting that he had no active role in the crime. The defense also pointed out that the police have already seized crucial evidence, including CCTV footage and the alleged weapons used in the assault, and that the investigation is nearly complete. On these grounds, Dere contended that bail should be granted, but the court remained unconvinced.
Arrests and Incident Details
The Byculla police took swift action on Monday, arresting Khaliq Khan, his son Umarshad (a builder by profession), and a relative named Sohaib Khan. The incident unfolded on Saturday night when the complainant, Yusuf Khan, was returning home in his car. According to reports, Yusuf Khan inadvertently drove through a puddle, splashing water on Shoaib Pathan. Despite stopping to apologize, Shoaib Pathan allegedly reacted with rage, assaulting Yusuf Khan and damaging his car's windshield. Yusuf Khan then returned home and informed his family, who insisted on filing a formal police complaint.
Later, as Yusuf Khan and his family were exiting their building, they were confronted again by Shoaib Pathan, accompanied by Khaliq Khan and Umarshad. The confrontation escalated into a violent assault, with the accused allegedly using bamboo sticks to attack Yusuf Khan and his brother, Salman. This second altercation resulted in serious injuries and prompted the police to intervene.
Legal Proceedings and Future Steps
With the bail application rejected at the metropolitan magistrate's court, sources indicate that the accused are likely to pursue further legal avenues. It is anticipated that they will move to the sessions court to seek bail, highlighting the ongoing legal battle in this high-profile case. The court's decision underscores the seriousness with which such violent incidents are being treated, particularly when they involve public figures or their families.
The case has drawn significant attention due to its connection to cricketer Yusuf Pathan, adding a layer of public interest to the legal proceedings. As the investigation nears completion, all eyes will be on the upcoming court sessions to see how the evidence unfolds and what further decisions are made regarding the accused's custody and trial.
