The court's decision came after authorities failed to provide adequate police escort for prisoners requiring hospital visits. Principal Sessions Judge S Karthikeyan noted that election-related law and order arrangements have stretched police resources thin. This month alone, there have been at least five instances where large police deployments were needed for security arrangements, leaving insufficient personnel for prisoner transportation duties.

Judge Karthikeyan passed the interim order despite strong objections from the prosecution team. The state argued that Arul should first be evaluated by a board of government doctors to verify the authenticity of his medical complaints. The prosecution further suggested that if treatment was genuinely needed, it could be provided at Government Stanley Hospital under proper supervision.

Prosecution Concerns and Court's Reasoning

The prosecution raised significant concerns about granting bail, warning that the state would lose full control over the accused and that he might commit further crimes if released. They emphasized the serious nature of the allegations against Arul in the high-profile political murder case.

However, the court carefully examined the records and noted that Arul has been in incarceration for 572 days since his arrest on July 6, 2024. While acknowledging the gravity of the charges, the court determined that the medical grounds presented in the bail petition warranted consideration, especially given the practical difficulties in providing hospital escorts.

Bail Conditions and Surrender Date

The court imposed strict conditions on the interim bail grant:

  • The accused must appear and sign before the court daily at 10:30 AM when not hospitalized
  • He must surrender to authorities on April 10, 2024
  • The bail is specifically for medical treatment purposes
