The District Consumer Disputes Redressal Forum has directed a tyre dealer to refund the cost of a set of tyres that developed damage within three months of purchase. The complainant, a resident of Chandigarh, had bought four tyres for his vehicle from the dealer in March 2023. Within three months, the tyres showed abnormal wear and tear, with treads wearing out unevenly. The complainant approached the dealer for a replacement or refund, but the dealer refused, citing normal wear and tear.

The consumer then filed a complaint with the District Consumer Disputes Redressal Forum, arguing that the tyres were defective and not fit for use. During the hearing, the forum examined the tyres and found that the damage was indeed due to manufacturing defects. The dealer's claim of normal wear and tear was rejected as the tyres had been used for only a short period.
Forum's Decision
The forum ordered the dealer to refund the full cost of the tyres, amounting to Rs 24,000, along with interest at 9% per annum from the date of purchase. Additionally, the dealer was directed to pay Rs 5,000 as compensation for mental agony and Rs 2,000 towards litigation costs. The forum also observed that consumers should not suffer due to defective products and that manufacturers and dealers must ensure quality.
