The First Information Report (FIR) names Horikam Engineers and Silpa Horikam JV Hyderabad—the agencies responsible for constructing and operating the water booster—along with an engineer involved in the project.

The charges have been filed under multiple sections of the Bharatiya Nyaya Sanhita (BNS), including:

  • Section 106: Causing death by negligence
  • Section 282: Rash navigation of vessel
  • Section 290: Negligent conduct with respect to pulling down, repairing or constructing buildings

A police officer involved in the case stated, "We are thoroughly examining the role of the contractor, engineers, and the agency to ascertain whether mandatory safety protocols were followed during the construction and operation of the water tank." Preliminary investigations reveal that the tank lacked essential safety features, including a protective mesh or proper covering, which could have prevented this tragedy.

According to eyewitness accounts and family members, Shivam had stepped out to play around 5:30 PM on the fateful day. He was playing in the vicinity of the water booster when he accidentally fell into the uncovered tank approximately an hour later.
