In a significant verdict highlighting corruption at the grassroots level, a court in Tehri Garhwal district has sentenced former village head Beena Devi and panchayat development officer Dinesh Prasad Dangval to three years of rigorous imprisonment for misappropriating over Rs 5 lakh in panchayat funds. The case, which dates back to financial irregularities between 2013 and 2014, underscores ongoing challenges in local governance accountability.

How the Embezzlement Scheme Was Uncovered

The fraudulent activities came to light in October 2017 when a vigilant resident of Dhamadi village, Indra Singh Chauhan, filed an official complaint with authorities. Chauhan alleged that a substantial sum of Rs 5.65 lakh had been withdrawn from the Gram Panchayat account during the 2013-2014 period under the guise of funding various development projects. However, upon investigation, it was revealed that no actual work had been executed on the ground despite the funds being disbursed.

A thorough probe was subsequently initiated, with investigating officer Chauhan being assigned by the block development officer to examine the allegations in detail. The investigation confirmed the misappropriation, finding concrete evidence that no construction or development activities had been undertaken for the projects for which the money had been allocated and withdrawn.

Court Proceedings and Defense Arguments

During the trial, both accused presented their defenses before the court. Beena Devi, the former village head of Dhamadi, claimed she had been falsely implicated in the case, citing her illiteracy as a factor that prevented her from understanding the documentation involved. Meanwhile, Dinesh Prasad Dangval, the village panchayat development officer, alleged that his signature on the cheque used to withdraw the funds had been forged without his knowledge or consent.

The case also involved another accused, the then assistant development officer Jaypal Singh, who was named in the initial charges. However, Singh passed away during the pendency of the legal proceedings, leading to the case against him being abated.

Evidence and Final Judgment

The prosecution built a strong case by examining a total of 11 witnesses and presenting comprehensive records and relevant documents to substantiate the allegations of fund misappropriation. After carefully evaluating all evidence and hearing arguments from both the prosecution and defense, the court of the Chief Judicial Magistrate in Tehri Garhwal delivered its verdict on Saturday.

The court convicted both Beena Devi and Dinesh Prasad Dangval under Section 409 of the Indian Penal Code, which deals specifically with criminal breach of trust by a public servant. In addition to the three-year prison sentence, the court imposed a fine of Rs 10,000 on each convict. This judgment sends a clear message about the serious consequences of betraying public trust and misusing government funds meant for community development.

The case highlights the importance of transparency and accountability in local governance, particularly in the utilization of panchayat funds intended for rural development projects.
