Bhopal IVF Center Sealed for Legal Violations

Bhopal Health Department Takes Strict Action Against Medical Facilities

In a significant crackdown on medical irregularities, the health department in Bhopal sealed an IVF center and a sonography unit on Thursday after uncovering serious violations under multiple regulatory acts. This enforcement action marks a notable step in ensuring compliance with healthcare laws in the region.

Unprecedented Shutdown of IVF Facility

Officials have indicated that this is potentially the first instance in the state where an IVF facility has been forcibly closed due to legal breaches. The operation was conducted with the presence of an assistant district prosecutor officer, underscoring the gravity of the violations detected.

Dr. Manish Sharma, the Chief Medical and Health Officer (CMHO) of Bhopal, provided details on the inspection. "The inspection team found serious irregularities in both centers. After examining the documents, an FIR will be registered against the operators soon," he stated, highlighting the legal consequences awaiting the facility operators.

Specific Violations Uncovered

The inspection revealed that the Ishwarya Fertility Centre, located within Marvel Hospital on Ayodhya Bypass Road, was operating illegally. Key findings include:

  • Lack of proper registration under the Nursing Home Act.
  • Absence of mandatory approvals required under the PC&PNDT Act and the ART Act.
  • Irregularities at the sonography center inside Marvel Hospital, such as improper maintenance of Form F and incomplete entries in the ANC register.

Humanitarian Considerations Amid Enforcement

Despite the strict action, authorities demonstrated compassion by allowing cryogenically preserved IVF embryos and samples to remain stored on humanitarian grounds. This decision ensures that potential future treatments are not jeopardized while addressing the legal issues.

The sealing of these facilities serves as a stern warning to other medical establishments to adhere strictly to regulatory frameworks, safeguarding patient rights and healthcare standards in Bhopal.
