The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has taken strict action against three real estate developers for failing to register their projects with the regulatory body. In a significant enforcement move, the authority has imposed fines of Rs 5 lakh each on the promoters behind two Noida projects—Estate 105 and Sobha Rivana—as well as a Lucknow-based project called Avikalp Estate.

Investigation Reveals Unregistered Project Promotion

Officials conducted an inquiry that uncovered these projects were being actively promoted through various channels, including websites, despite lacking the mandatory registration with UP-RERA. According to an official statement, notices were issued to the developers, who submitted replies that were ultimately deemed unsatisfactory by the regulatory authority.

"They were found to be in violation of Section 3 of the Real Estate (Regulation and Development) Act, 2016, which makes registration of any real estate project with UP-RERA compulsory. Consequently, a fine of Rs 5 lakh each has been levied on the developers of these three projects," stated a UP-RERA official.

Mandatory Registration Requirements Under RERA

As per the UP-RERA Act, registration is compulsory for any real estate project located within a planning area that meets specific criteria:

  • Land area exceeding 500 square meters
  • Projects comprising more than 8 apartments or flats

The law explicitly prohibits advertisement, marketing, booking, sale, or promotion of such projects through any medium prior to registration. Such activities are considered punishable offenses under the regulatory framework.

Severe Penalties for Non-Compliance

Under Section 59 of the RERA Act, promoters found violating registration requirements can face fines up to 10% of the estimated project cost. The authority has emphasized that continued violations or failure to comply with its orders may result in additional financial penalties or even imprisonment for the developers.

"Promotion or sale of any project without registration constitutes a serious violation of the Act. No leniency will be shown in such matters, and strict action against defaulting promoters will continue in the future," declared UP-RERA Chairperson Sanjay Bhoosreddy, underscoring the authority's commitment to regulatory enforcement.
