Karnataka Rera Ramps Up Enforcement Against Unregistered Real Estate Projects
The Karnataka Real Estate Regulatory Authority (K-Rera) has significantly intensified its scrutiny of unregistered real estate developments across the state. This proactive drive focuses on identifying violations, verifying project statuses, and initiating stringent actions against errant promoters to safeguard the interests of homebuyers.
Complaints and Actions Taken by the Authority
According to official data from K-Rera, a total of 765 complaints have been received since 2021 regarding projects that were not registered under the regulatory framework. Out of these, orders have been passed in 440 cases, while 325 cases are currently under various stages of hearing and processing. The authority has issued multiple notices, in some instances up to three times, to elicit responses from promoters and establish the facts surrounding each project.
Officials highlighted that a significant portion of these complaints relate to projects that may not even exist on the ground or were already registered, necessitating a verification-first approach. This careful scrutiny helps filter genuine violations from misunderstandings or errors in reporting.
Legal Requirements and Structural Gaps
Under the Real Estate (Regulation and Development) Act, 2016, any residential project with more than eight units or a land area exceeding 500 square meters must be registered with the authority. However, officials pointed to structural gaps that allow some promoters to bypass this mandatory registration.
Planning authorities, such as those in urban development departments, can grant project approvals and issue occupancy certificates independently of K-Rera. Moreover, Rera registration is not a mandatory prerequisite during property registration with other authorities, including the stamps department. A senior official from K-Rera explained, "As the registration is not tightly linked to other approvals, some promoters tend to skip it. Unless other statutes make it compulsory, a few builders try to proceed without registering."
Risks Associated with Unregistered Projects
Unregistered projects are those launched without the mandatory Rera registration or proper disclosures on approvals. They are considered highly risky as they escape regulatory scrutiny, increasing the chances of fraud, safety concerns, and legal disputes for homebuyers. When projects are registered, buyers gain access to verified information on approvals, timelines, and finances, providing a layer of protection against potential malpractices.
Challenges and Homebuyer Perspectives
One of the biggest challenges identified by Rera officials is the low awareness among buyers. Many purchasers still do not check Rera registration details and rely heavily on builders' assurances, leaving them vulnerable to delays and legal complications. Dhananjaya Padmanabhachar, convenor of the Karnataka Home Buyers Forum, emphasized, "It's the responsibility of Rera to ensure every eligible project gets registered under Rera without exception. This will ensure home buyer protection."
R Rajagopalan, convenor of the Bengaluru Coalition, added, "The root problem lies in how approvals are granted, and while court views are one part, the bigger issue is buyer awareness. What we need is proactive protection of citizens' rights by government and statutory bodies." He noted that many violations occur in grey areas, such as unit count or square footage, where loopholes are exploited, highlighting the need for comprehensive compliance measures.
Ongoing Efforts and Future Directions
K-Rera's ongoing drive aims not only at enforcement but also at educating stakeholders and closing regulatory loopholes. The authority is leveraging data from its records to scrutinize promoters and ensure that homebuyers' rights are protected. This includes addressing cases where promoters attempt to re-register cancelled projects under new company names to evade scrutiny.
By intensifying its crackdown on unregistered projects, K-Rera seeks to create a more transparent and secure real estate environment in Karnataka, ultimately fostering greater trust and confidence among homebuyers and investors alike.
