Gurgaon DTCP Uncovers Illegal Property Transactions in Commercial Complex
The Haryana Department of Town and Country Planning (DTCP) has raised serious concerns about illegal sale deeds executed in a prominent commercial project in Gurgaon. The department has formally sought disciplinary and legal action against revenue officials for allegedly violating established urban development regulations.
Violations at Bristol Hotel-cum-Commercial Complex
According to official documents, the irregularities center around the Bristol Hotel-cum-commercial complex located on MG Road in Sikanderpur Ghosi. The property was developed on land where Change of Land Use (CLU) permission had been granted back in 1995. A CLU represents the mandatory legal procedure for converting land from one designated purpose to another under Haryana's urban planning framework.
The DTCP enforcement wing has identified that the CLU holder, Bright Star Hotels Pvt Ltd, executed sale deeds transferring units within the complex to various third parties. This occurred despite the fact that obtaining a proper license under Section 3 of the Haryana Development and Regulation of Urban Areas Act, 1975, is compulsory before any such plot transfers or colony development can legally proceed.
Departmental Directives Ignored
Gurgaon Town Planner (Enforcement) Amit Madholia explained that following directions from the director of town planning's office, the department had specifically instructed Wazirabad tehsildar and naib tehsildar officials not to register any properties linked to this complex after rule violations were discovered at the Bristol Hotel premises.
"Despite clear departmental directions issued in December 2025 that explicitly prohibited any sale or registration activity concerning this property, a sale deed was nevertheless registered on December 29, 2025," stated an official familiar with the matter. The DTCP has characterized this action as a willful and mala fide act demonstrating deliberate disregard for legal protocols.
Legal Framework and Enforcement Actions
The department has cited Section 7 of the Haryana Development and Regulation of Urban Areas Act, which explicitly prohibits several activities without proper licensing, including:
- Advertising or offering plots for sale
- Transferring plots through sale, lease, or gift deeds
- Erecting buildings or carrying out development work
- Receiving any payment in connection with unlicensed development
DTCP records show that on December 8, 2025, the enforcement wing issued a show-cause notice under Section 10(2) of the Act. The very next day, on December 9, 2025, the tehsildar of Gurgaon was formally instructed not to register any sale, lease, or gift deed for the disputed site.
Call for Investigation and Accountability
In a strongly worded letter dated January 29 to the Financial Commissioner (Revenue), the DTCP has demanded a thorough inquiry into the matter. The department alleges that the tehsildar of Wazirabad registered the December 29, 2025 sale deed "wilfully and with malafide intention," essentially making the official a party to an illegal act.
The letter seeks initiation of appropriate legal action against the concerned officers as per established law. A senior official, speaking on condition of anonymity, emphasized that strict enforcement is necessary to deter unauthorized property transfers and ensure commercial developments comply with licensing requirements, environmental standards, and urban planning norms.
The land in question, measuring 15,881 square yards, falls within the municipal limits and urban area of Gurgaon, making compliance with urban development regulations particularly critical for orderly city growth and legal property transactions.
