Goa RERA orders flat handover to Gurugram buyer

Panaji: The Goa Real Estate Regulatory Authority (RERA) has directed Margao-based developer Aansav Realty and Infrastructure Pvt Ltd to execute a sale deed and hand over possession of a 137sqm flat in its Aansav Verde project at Varca to a Gurugram-based buyer, Sonia Singh Bhardwaj, within 60 days.

RERA finds unlawful cancellation

The RERA found that the developer unlawfully cancelled her allotment and failed to deliver the apartment more than seven years past the stipulated deadline. RERA member Vincent D’Silva told the developer to pay Rs 10 lakh as penalty under the RERA Act for violating its provisions, and Rs 5 lakh as costs to the complainant, both payable within two months, failing which further legal proceedings will be initiated. The RERA asked the woman to pay the outstanding dues so that the handover of the flat can be completed.

Details of the booking

Bhardwaj booked a 137sqm flat on the first floor of Block P of Aansav Verde for a total consideration of Rs 53 lakh in 2015. The developer was obligated to deliver possession by July 2018, three years from the first payment, as per Supreme Court precedent, but obtained the completion certificate only on Nov 21, 2025, and the occupancy certificate on Dec 4, 2025.

The authority found that the developer’s cancellation of the allotment letter in March 2023 was illegal and without basis, as WhatsApp messages between the developer’s sales manager and the complainant’s husband as late as Feb 2025, confirmed an outstanding balance of only Rs 8.9 lakh.

The developer claimed the woman was an investor and not a genuine homeowner, which the RERA rejected.
