Haryana Government Unveils Comprehensive Labor Reforms for Business Flexibility

The Haryana government has taken a significant step toward modernizing labor regulations with a new notification that establishes clear and comprehensive guidelines for employee working hours while granting unprecedented operational flexibility to businesses across the state. This landmark decision replaces the previous 2009 notification and aims to strike a careful balance between business efficiency and worker protection.

Strict Limits on Employee Working Hours

Under the newly established rules, employee working hours are now strictly regulated with clear upper limits. No employee can be required to work more than 48 hours in a single week or exceed 10 hours in any given day. The total daily working hours, which must include all rest intervals, is capped at a maximum of 12 hours. These provisions ensure that workers are protected from excessive work demands while allowing businesses reasonable operational windows.

Perhaps most significantly, the notification mandates that employers must pay overtime wages at twice the normal rate for any work performed beyond these established limits. Additionally, no employee is permitted to work for more than six consecutive hours without receiving a break of at least 30 minutes, ensuring adequate rest periods throughout the workday.

Round-the-Clock Business Operations Now Permitted

In a major shift from previous regulations, the labor department's notification grants shops and commercial establishments exemptions from fixed opening hours and mandatory weekly closures. This revolutionary change allows eligible businesses to operate continuously around the clock, provided they complete a straightforward online registration through a self-certification system.

This exemption specifically removes businesses from the requirements of sections 9 and 10 of the Haryana Shops and Commercial Establishments Act, 1958, which previously imposed strict limitations on operating hours. The move is designed to enhance business competitiveness and respond to changing consumer patterns in today's 24-hour economy.

Enhanced Employment Opportunities for Women

The notification introduces progressive provisions regarding women's employment during night shifts. Businesses are now permitted to employ women during the hours from 8 pm to 6 am, representing a significant expansion of employment opportunities. However, this permission comes with important safeguards.

Establishments must first obtain approval through an auto-mode exemption process and remain fully compliant with previously notified safety and security conditions. This balanced approach aims to expand economic participation while ensuring workplace safety remains paramount.

Implementation and Compliance Requirements

Rajeev Ranjan, principal secretary of the Haryana labor department, emphasized that these exemptions do not override laws or directives issued by other authorities, including police departments or other government agencies. To ensure maximum transparency and awareness, all establishments are required to prominently display a copy of this notification at every entry and exit point used by employees.

Officials have confirmed that this comprehensive decision completely replaces the 2009 notification and represents a thoughtful approach to improving the ease of doing business across Haryana. The reforms are designed to create a more flexible business environment while maintaining essential labor protections and prioritizing worker welfare in all circumstances.
