The state of Florida has filed a lawsuit against OpenAI and its CEO, Sam Altman, accusing the artificial intelligence company of prioritizing profits over safety despite knowing that its product, ChatGPT, poses risks. This marks the first legal action by a US state against the company concerning the safety of its AI offering.
Allegations by Florida Attorney General
Florida Attorney General James Uthmeier stated, "Sam Altman and ChatGPT have chosen the AI race over the safety and security of our kids. They have chosen profit over public safety, and we're not going to stand for it here in Florida." The lawsuit accuses Altman of harming Floridians through his "reckless and willful conduct as founder and CEO of OpenAI, including his utter disregard for the risk to human life caused by his firm's conduct."
Specific Concerns Raised
The state alleges that OpenAI has gotten minors addicted to ChatGPT without adequate parental oversight. Furthermore, the lawsuit claims that ChatGPT has been used to assist mass shooters, encourage suicide, and cause public humiliation. These allegations build on a criminal investigation launched by the Florida Attorney General in April 2026, which examined the use of ChatGPT in a mass shooting at Florida State University.
OpenAI's Response
In response, OpenAI emphasized its commitment to safety, stating that it has built tools specifically to protect minors. The company said, "We built safety for minors directly into our products, including a more protective experience specifically for minors, an age prediction tool, defaulting users whose age we are not confident into our more protective experience, and giving parents tools to monitor their kids' use of AI." OpenAI acknowledged that this work cannot undo past harms but reaffirmed its dedication to improving safety.
The civil lawsuit is the first of its kind against OpenAI and its CEO, highlighting growing concerns over the potential misuse of AI technology. The case is expected to set a precedent for how AI companies are held accountable for the societal impact of their products.
