Following similar actions by Disney and Paramount, the streaming behemoth has issued a cease-and-desist letter to TikTok's parent company, ByteDance, concerning its AI video generation model, Seedance 2.0. In the letter, Netflix describes the technology as "a high-speed piracy engine" that systematically replicates copyrighted material without authorization.

Viral AI Video Sparks Controversy

Seedance 2.0 gained significant attention online after a user created a viral video depicting individuals resembling Tom Cruise and Brad Pitt engaged in a rooftop fight. While some observers marveled at the AI's advanced capabilities, many in the creative industries expressed serious concerns about the potential for widespread copyright violations and the undermining of original content creation.

Netflix's Allegations of Infringement

In its formal communication to ByteDance, Netflix detailed specific instances where Seedance 2.0 allegedly generated AI videos mimicking characters and settings from some of its most popular titles. The streaming service cited unauthorized reproductions from hit series such as "Stranger Things," "Bridgerton," and "Squid Game," as well as the animated film "KPop Demon Hunters." Netflix emphasized that these activities constitute willful copyright infringement, arguing that the use of protected works to create competing commercial products does not qualify as fair use.

Key Demands from Netflix

To avoid immediate litigation, Netflix has demanded that ByteDance take several corrective actions:

  1. Cease Generative Output: Implement technological safeguards to prevent Seedance from producing any content resembling Netflix's intellectual property.
  2. Remove Infringing Content: Delete all unlawfully obtained Netflix-owned material from training datasets and eliminate existing Seedance-generated videos featuring Netflix IP from ByteDance platforms.
  3. Identify All Infringements: Provide a comprehensive account of all instances where Seedance generated content based on Netflix-related prompts.
  4. Revoke Third-Party Access: Terminate access for commercial partners or API users utilizing Seedance to create unauthorized Netflix derivatives.

Netflix has given ByteDance a deadline of three business days to respond, reserving all legal rights and remedies.

ByteDance's Response

A ByteDance spokesperson responded to the allegations, stating that the company "respects intellectual property rights" and has "heard the concerns regarding Seedance 2.0." The spokesperson added that ByteDance is taking steps to enhance existing safeguards to prevent unauthorized use of intellectual property and likenesses by users, as reported by Business Insider.

This legal confrontation highlights the growing tensions between major entertainment studios and tech companies over the ethical and legal boundaries of artificial intelligence in content creation.
