India's New Online Gaming Rules Effective May 1, 2026

The Indian government has introduced new regulations for online gaming through the Promotion and Regulation of Online Gaming Act, which will take effect from May 1, 2026. The framework aims to bring structure to the rapidly growing industry, distinguishing between online money games, social games, and esports.

Key Features of the Regulations

The regulations are described as 'regulation-light' by officials, but they include mandatory requirements for certain categories. The creation of the Online Gaming Authority of India under the Ministry of Electronics and Information Technology will oversee classification, grievances, and enforcement.

Classification and Registration

Not all games require mandatory registration. Esports must register, while social games have optional registration unless specified otherwise. Online money games remain prohibited under existing laws. The classification process considers factors such as money deposits, fees, expected winnings, and monetization outside the game. Classification decisions are expected within 90 days of a complete application.

User Safety Features

The rules introduce user safety features including age verification, age-gating, parental controls, time restrictions, reporting mechanisms, and counseling support. Grievance systems must be clearly displayed by platforms seeking registration.

Online Gaming Authority

The authority will include representatives from Home Affairs, Finance, Information and Broadcasting, Youth Affairs and Sports, and Law and Justice. It will maintain a list of money games, handle complaints, and coordinate with banks and law enforcement. A two-tier appeal system allows users to approach the authority within 30 days and then the Appellate Authority headed by the MeitY Secretary.

Compliance and Banking Checks

Registration is required only for platforms specified by the government. Registered platforms receive a digital certificate valid for up to 10 years and must display registration details. Banks may verify certificates before processing transactions and can restrict transactions linked to money games.
