Tripura Enforces Property Damage Act After ADC Poll Violence

Agartala: In response to the recent surge in post-poll violence following the Tripura Tribal Areas Autonomous District Council (ADC) elections, the state government has decided to implement the Tripura Recovery of Damages to Public and Private Property Act, 2021. This move aims to hold perpetrators accountable and ensure compensation for the damages caused, Director General of Police (DGP) Anurag said.

Background of the Violence

The unrest erupted after the declaration of results for the ADC elections on April 17, leaving more than 500 people homeless and causing extensive damage to public and private properties. The violence necessitated a strong legal response to address the losses and prevent future incidents.

Details of the Act

While the Act was passed by the state assembly in April 2021 to address such situations, including those arising from clashes, strikes, riots, bandhs, and public protests, it had yet to be thoroughly enforced until now. The legislation facilitates the recovery of damages through the formation of claims tribunals, which assess losses and determine the appropriate compensation. A claims commissioner, appointed by the state government, oversees this process.

Under the Act, “damages” encompass any loss, injury, or deterioration caused by individuals or groups, while “mischief” aligns with its definition under Section 425 of the Indian Penal Code. In cases of violence, police must submit a detailed report to the claims tribunal within three months. The tribunal then evaluates the degree of damage and assesses compensation to be reclaimed from those responsible.

Immediate Relief Measures

To address immediate relief needs, Chief Minister Manik Saha visited the affected areas and allocated Rs 64.5 lakh from the Chief Minister’s Relief Fund to assist victims and their families. However, this support is only a partial measure given the extent of the destruction. Speaking after a review meeting on the situation, Saha emphasized the importance of enforcing the Act to not only recover damages from offenders but also deter future incidents.

Enforcement and Impact

The enforcement of the Act marks a significant step in the state’s efforts to curb post-election violence. By holding perpetrators financially accountable, the government aims to send a strong message against such acts. The claims tribunals will play a crucial role in ensuring that victims receive compensation and that offenders bear the cost of their actions.

The Tripura government’s decision comes amid ongoing concerns about law and order in the region. The ADC elections, which are crucial for tribal governance, have often been marred by violence. The implementation of this Act is expected to provide a legal framework to address such issues effectively.

As the state moves forward, the focus remains on restoring normalcy and ensuring justice for the victims. The government has urged citizens to cooperate with authorities and report any further incidents of violence or property damage.
