SC Stays HC Order Annulling Congress MLA's Bypoll Win in MP

Supreme Court Intervenes in Madhya Pradesh Bypoll Controversy

In a significant legal development, the Supreme Court of India has provided a major interim relief to the Congress party by staying the Madhya Pradesh High Court's ruling that had annulled the 2024 bypoll victory of party MLA Mukesh Malhotra. The apex court's decision, delivered on Thursday, temporarily suspends the earlier judgment from the Gwalior bench of the MP High Court, which had invalidated the assembly bypoll outcome.

Background of the Electoral Dispute

The controversy stems from a petition filed by Mukesh Malhotra's closest BJP rival, Ram Niwas Rawat, who contested the bypoll results. Rawat alleged that Malhotra failed to disclose criminal cases against him in his election affidavit during the nomination process. In response to this plea, the High Court last week annulled the bypoll win of the Congress candidate, citing this non-disclosure as grounds for invalidation.

Mukesh Malhotra, a first-time MLA, had secured victory in the November 2024 bypoll for the Vijaypur assembly constituency, defeating former minister for forests and environment Ram Niwas Rawat by a substantial margin of 7,364 votes. Following the High Court's adverse ruling, the Congress party, as the principal opposition in Madhya Pradesh, swiftly challenged the decision in the Supreme Court.

Conditions Imposed by the Supreme Court

While upholding Mukesh Malhotra's status as the elected MLA from Vijaypur assembly constituency, the Supreme Court imposed several important conditions as part of its interim order. The court ruled that until the final verdict is delivered, Malhotra will not be permitted to cast his ballot during the upcoming Rajya Sabha elections. Additionally, he is barred from participating in voting during assembly polls.

The restrictions extend to financial matters as well. The Congress legislator will not be able to draw his salary and perks as a member of the legislative assembly, nor will he have access to funds under the Member of Legislative Assembly Local Area Development Scheme (MLALADS). Despite these limitations, Malhotra will retain his position as Vijaypur MLA until the Supreme Court issues its final judgment in the case.

The apex court has allowed Malhotra to attend assembly proceedings until the next hearing scheduled for July 23. The court explicitly stated in its ruling: "Till the next date of hearing, there shall be a conditional stay of the impugned judgement and order to the following extent: The appellant shall be entitled to participate in the proceedings of the legislative assembly."

Legal Representation and Political Reactions

In the Supreme Court proceedings, Mukesh Malhotra was represented by lawyer and Congress Rajya Sabha MP Vivek Tankha along with advocate Sameer Sodhi. Following the court's decision, Malhotra expressed satisfaction with the interim order, stating: "Former minister Ram Niwas Rawat moved HC contending that I had not disclosed criminal cases registered against me while filing nomination papers. But I did not hide any detail. I am satisfied with the interim order by the Supreme Court."

The Congress MLA further emphasized his commitment to his constituency despite the restrictions: "I may not be able to access my MLALADS funds or draw my salary. But that doesn't make a difference to me, as I will continue to work for the development of my constituency and its people, regardless."

Congress state president Jitu Patwari welcomed the Supreme Court's intervention, characterizing it as a "historic win of truth, justice, democracy and the constituency." Meanwhile, the governing BJP adopted a more measured response to the development. BJP state general secretary Bhagwandas Sabnani commented: "We respect the apex court's order and will abide by it. But Mukesh Malhotra cannot vote in the Rajya Sabha election and will neither be able to draw his salary till the SC pronounces its final verdict. Let's wait for the final ruling."

Implications and Future Proceedings

The Supreme Court's conditional stay represents a temporary resolution to a contentious electoral dispute that has significant political implications in Madhya Pradesh. The case highlights ongoing tensions between disclosure requirements for electoral candidates and the interpretation of such requirements in legal challenges to election outcomes.

With the next hearing scheduled for July 23, all parties involved will await the Supreme Court's final verdict on whether the High Court's annulment of the bypoll results should stand or be overturned. The outcome will not only determine Mukesh Malhotra's political future but may also establish important precedents regarding election affidavit disclosures and the grounds for challenging electoral victories in Indian courts.

This legal battle underscores the complex intersection of electoral politics, legal accountability, and constitutional processes in India's democratic framework, with both major political parties closely monitoring developments as they prepare for future electoral contests in the state.
