Kejriwal Seeks Judge Recusal in Delhi High Court Over Liquor Scam Allegations
In a significant legal development, former Delhi Chief Minister Arvind Kejriwal, along with other former accused individuals, on Sunday moved a recusal application before Justice Swarn Kanta Sharma in the Delhi High Court. This application pertains to the alleged liquor scam case that has been under intense scrutiny.
Kejriwal to Argue Personally in Court on Monday
According to the Aam Aadmi Party (AAP), Kejriwal is set to appear and argue his case personally on Monday. This move underscores his direct involvement in the legal proceedings and highlights the high stakes of the matter.
Background: High Court's Final Opportunity and ED's Plea
This development comes just days after the Delhi High Court granted a final opportunity to Kejriwal and the other accused to file their responses. They must address a plea by the Enforcement Directorate (ED) seeking to expunge what it termed as "unwarranted" remarks made against it by the trial court. These remarks were issued when the trial court discharged the accused in the liquor policy case.
Earlier Appeal for Case Reassignment to Another Judge
On March 11, Kejriwal, leading the group, appealed to Chief Justice Upadhyaya, requesting that the case be assigned to another judge whom he described as "impartial". In his representation, Kejriwal expressed a "grave, bona fide, and reasonable apprehension" that the hearings would not be conducted with the necessary impartiality and neutrality under the current judge.
Challenge to Justice Sharma's Order on CBI Investigation
Additionally, Kejriwal has formally challenged Justice Sharma's order dated March 9. In that order, she put on hold a directive from the trial court that had called for an investigation into the CBI officer who was involved in probing the excise policy case. This challenge adds another layer of complexity to the ongoing legal battle.
