Delhi Court Clears Former Congress MP Vijay Darda and Others in Coal Block Allocation Case
A special Delhi court on Friday acquitted former Congress MP Vijay Darda, his son Devendra, former coal secretary H C Gupta, and several other individuals in a high-profile coal block allocation case. The decision marks the conclusion of a trial that spanned over a decade, with the court finding the evidence presented by the prosecution to be highly insufficient to substantiate charges of cheating, conspiracy, or misconduct.
Case Background and Charges
The case originated from the allocation of a coal block in Maharashtra's Bandar region, which was part of the broader coal block controversy that emerged during the tenure of the Congress-led United Progressive Alliance (UPA) government. The First Information Report (FIR) was filed in 2012, followed by a chargesheet from the Central Bureau of Investigation (CBI) in 2014.
The CBI had alleged that AMR Iron and Steel Private Ltd, which secured the coal block, conspired with Gupta to submit false information to a screening committee of the Union coal ministry. Additionally, it was claimed that Vijay Darda, then a Rajya Sabha MP, wrote to various departments to influence the allocation process and received Rs 24.6 crore as illegal gratification.
Court's Ruling and Observations
Judge Sunena Sharma, presiding over the case, delivered the acquittal verdict, emphasizing that the evidence was too sparse to establish key elements required for conviction. The court noted a lack of proof regarding criminal conspiracy, stating that the case was built on conjectures and failed to demonstrate a meeting of minds or any illegal agreement among the accused.
In her detailed judgment, Sharma highlighted that the material on record was insufficient to conclusively prove deception, inducement, dishonest intention, or cheating under Section 420 of the Indian Penal Code (IPC). The judge pointed out that there was no tangible evidence linking the accused to the alleged misconduct, thereby leading to their acquittal.
Acquitted Individuals and Legal Representation
Alongside Vijay Darda, Devendra Darda, and H C Gupta, the court also cleared AMR Iron and Steel Private Ltd, its director Manoj Kumar Jayaswal, and two other individuals. Advocate Mudit Jain represented Jayaswal, the Dardas, and AMR, while lawyer Rahul Tyagi appeared on behalf of Gupta during the proceedings.
Supreme Court's Emphasis on Legal Procedures
In a related context, the Supreme Court of India has reiterated the importance of adhering to legal protocols, particularly in cases involving sensitive matters. The apex court emphasized that courts must avoid giving undue weight to minor discrepancies in witness testimonies, as truthful witnesses may make honest mistakes or omit immaterial details.
The Supreme Court also stressed the need for strict compliance with provisions protecting the identity of survivors in certain cases, noting that failure to do so can lead to stigmatization. It directed that copies of relevant judgments be sent to all high courts to ensure proper implementation of these guidelines.
Implications and Conclusion
This acquittal brings closure to a long-standing legal battle that had its roots in the coal block allocation scandals of the UPA era. The court's decision underscores the principle that convictions must be based on robust and conclusive evidence, rather than assumptions or insufficient proof. As the trial concludes, the accused have been exonerated, highlighting the judicial system's commitment to due process and evidentiary standards.
