West Bengal Court Trials Face Major Disruptions Due to Judge Reassignments

In a significant development impacting the judicial process in West Bengal, several high-profile trials in lower courts are experiencing severe disruptions or are under threat of being halted. This situation arises as trial judges are being assigned Special Investigation Report (SIR) duties, leading to postponed hearings and stalled witness testimonies. Public prosecutors have expressed deep concerns over the potential delays in justice delivery for critical cases.

Key Cases Affected by Judicial Reassignments

The ongoing trials in the law college gang rape case and the Ranigung armed robbery, valued at approximately Rs 4 crore, have been put on hold. On Monday, the witness evidence process in the law college case was stalled when a key forensic expert could not testify due to the unavailability of the judge. Similarly, the Ranigung robbery trial at the Asansol court could not proceed on Tuesday because the presiding judge was occupied with SIR-related responsibilities.

Bivas Chatterjee, the special public prosecutor handling both cases, highlighted the critical nature of these delays. He stated, "A cyber expert was scheduled to testify for the government in the law college case, but the hearing did not occur, forcing him to return. We hope to complete this on March 23. Despite traveling to Asansol on Tuesday, even with a bomb scare, the witness testimony could not be conducted due to the judge's absence."

Legal Complications and Broader Impact

Defense lawyer Dibyendu Bhattacharya, involved in the law college rape case, confirmed that the hearing was canceled as the judge was engaged in SIR duties. Court sources indicate that while charges have been framed in this high-profile case, repeated delays from various legal issues, now compounded by SIR assignments, pose significant challenges. In the Ranigung incident from 2024, a seven-member gang attempted a Rs 4 crore robbery at a jewellery shop, which was thwarted by police intervention, including an exchange of fire with a sub-inspector.

Further exacerbating the situation, public prosecutors reported that another prominent trial, involving a murder case in Suri, Birbhum, also stalled on Tuesday. The final witness in that case was unable to testify, adding to the growing list of disrupted proceedings.

Upcoming Trials at Risk

Two more high-priority trials are scheduled to begin in district courts within the next 72 hours. These include the rape and murder of a 13-year-old tribal girl in Rampurhat and the gang rape of a medical student in Durgapur. However, Chatterjee remains apprehensive about their progress. He remarked, "I was assured that trials would not be affected, but given the current circumstances, I am keeping all options open. Extensive preparations are essential for these high-profile cases, and any disruption hampers the pursuit of justice."

The reassignment of judges to SIR duties has sparked fears among legal professionals about prolonged delays and potential setbacks in delivering timely verdicts. As the judicial system grapples with these challenges, stakeholders are calling for measures to ensure that critical trials proceed without unnecessary interruptions.
