Supreme Court Issues Stern Warning to States Over Sand Mafia Menace
The Supreme Court of India has voiced profound concern regarding the unchecked operations of powerful sand mafias across the nation, sharply criticizing state governments for what it termed a virtual abdication of their constitutional responsibilities to combat this environmental and legal menace.
Court Directs Immediate Action and Threatens Severe Measures
A bench comprising Justices Vikram Nath and Sandeep Mehta, in a hearing on Friday, delivered a series of stringent directives specifically targeting the states of Madhya Pradesh, Uttar Pradesh, and Rajasthan. The court mandated the installation of high-resolution, Wi-Fi-enabled CCTV cameras on all routes frequently exploited for illegal sand mining. It ordered round-the-clock monitoring of this footage and called for the immediate confiscation of vehicles involved in illicit activities.
Expressing frustration at the perceived reluctance of state authorities to act decisively, the bench issued a stark warning. It stated that if the situation does not improve, the court would be compelled to deploy paramilitary forces in the affected regions. Furthermore, it threatened to impose a complete ban on all sand mining activities within these states.
Bench Decries State Apathy and Possible Connivance
The court's observations were scathing in their assessment of state inaction. "It is indeed a matter of grave and serious concern that state authorities, who are entrusted with the solemn duty of enforcing the rule of law and protecting public resources, appear to have abdicated, if not altogether abandoned, their statutory and constitutional responsibilities," the bench remarked.
It went further, suggesting that the circumstances might even warrant an inference of tacit connivance. The bench highlighted a "disturbing pattern of inaction and administrative indifference" despite the issue being repeatedly raised in various legal and environmental forums.
"Having regard to the magnitude and seriousness of the issues involved in the present matter, as well as the prima facie lackadaisical approach adopted by the states concerned, this court cannot remain a silent spectator," the justices asserted.
Court Advocates for Preventive Detention and Stronger Prosecution
The Supreme Court pointedly noted that the existing statutory framework is sufficiently armed to tackle mining mafias, but administrative authorities seem to be "dragging their feet, for reasons which are not difficult to discern." In light of this, the bench strongly advised the concerned state governments to invoke provisions for:
- Preventive detention of suspects.
- Seizure and confiscation of immovable properties and machinery used in illegal operations.
- Undertaking effective and stringent prosecutions to ensure offenders are brought to justice.
The court expressed a "genuine apprehension" regarding the intent of state governments to act as protectors of the environment, citing their lackadaisical responses in proceedings before the National Green Tribunal.
Systemic Failure Highlighted by Violence Against Officials
In a particularly grave note, the bench referenced cases where state government officials have been killed by the sand mafia. It stated that such incidents reflect a systemic and institutional failure to discharge the state's legal obligations.
"Such apathy, particularly in the face of escalating environmental degradation and threats to human life, is both indefensible and wholly unacceptable in a constitutional democracy governed by the rule of law," the court concluded, underscoring the urgency and severity of the crisis.
