Pune Tribunal Directs PMPML to Pay Rs 85.4 Lakh Compensation in Fatal Accident Case
The Motor Accident Claims Tribunal (MACT) in Pune has issued a significant ruling, ordering the Pune Mahanagar Parivahan Mahamandal Limited (PMPML) to pay compensation of Rs 85.4 lakh to the family of a senior lab technician who tragically lost her life in a road accident in August 2023. The tribunal has given the public transport corporation a strict two-month deadline to deposit the amount.
Details of the Tragic Accident
The fatal incident occurred on August 21, 2023, at the Navratna Hotel Square along the Katraj-Swargate Road. According to tribunal records, a PMPML bus allegedly jumped a red traffic signal and collided with a scooter being ridden by Swapnali Sagar Waghule, a 38-year-old senior lab technician. Waghule was returning to her home in Bibwewadi from a prominent hospital in Erandwane where she was employed.
Eyewitness accounts and police documentation presented to the tribunal indicated that Waghule had properly started her two-wheeler only after the traffic signal had turned green, following standard road safety protocol.
Legal Proceedings and Tribunal's Findings
During the proceedings, PMPML's legal representative, Advocate Atul Gunjal, argued that the accident occurred within a bus rapid transport (BRT) lane and claimed that the scooter rider had been negligent by entering this designated lane, thereby contributing to the accident. The transport corporation indicated its intention to appeal the tribunal's decision in the Bombay High Court.
However, Presiding Member BD Kulkarni of the MACT thoroughly examined the evidence and dismissed PMPML's claims on April 18. The tribunal carefully reviewed police documents, including the spot panchanama and detailed road maps, which clearly showed that the accident site was situated in the middle of the square where no BRT lane exists.
The tribunal's examination revealed that the BRT lane actually ends at the edge of the square on both sides of the roads. Road maps submitted as evidence demonstrated that the road from Swargate to Katraj contained the BRT lane, but the square itself where the collision occurred did not feature this dedicated lane.
Analysis of Road Configuration and Negligence
The MACT provided a detailed analysis of the road configuration and vehicle movements at the time of the accident. Testimony from witness Baluram indicated that the scooter rider was proceeding toward Bibwewadi from Aranyeshwar direction. The tribunal noted that the vehicles involved were traveling on different roads that intersected at the square.
The bus was moving on the south-north road while the scooter was traveling on the east-west road. The tribunal posed a logical question in its ruling: "Why would the scooter rider enter the BRT lane, instead of proceeding straight?" This reasoning led the tribunal to conclude that the accident occurred solely due to the negligence of the bus driver, who failed to obey traffic signals.
Compensation Calculation and Distribution
The tribunal accepted documented evidence showing that the deceased, Swapnali Sagar Waghule, worked as a senior lab technician with an annual income of Rs 5.6 lakh. After applying appropriate deductions, using standard multiplier methods, and adding future prospects, the MACT computed the total compensation amount.
The comprehensive compensation package includes:
- Loss of income and future earnings
- Consortium benefits for the family
- Conventional heads of compensation
- An interest component of 7% amounting to nearly Rs 13.5 lakh
The interest will be calculated from the date the claim petition was presented and will continue to accrue until the actual payment is made. The tribunal has specifically ordered that the shares allocated to Waghule's two minor daughters be kept in fixed deposits until they reach the age of majority, ensuring their financial security.
