Pune Land Deal Case: Amadea Enterprises Partner Withdraws Anticipatory Bail Application

In a significant development in the ongoing Mundhwa government land parcel case, Digvijay Patil, a partner in Amadea Enterprises LLP, has withdrawn his anticipatory bail application from a city court in Pune. The case, registered by the Khadak police, is currently under investigation by the Economic Offences Wing (EOW), highlighting the legal complexities surrounding alleged irregularities in land transactions.

Reasons for Withdrawal and Legal Grounds

Patil cited the necessity to amend his pleadings and grounds for seeking anticipatory bail relief as the primary reason for the withdrawal. This decision came in the wake of a chargesheet filed by the police while his application was still pending. The case revolves around two illegal orders issued by suspended Pune city tehsildar Suryakant Yewale, which granted ownership rights of government lands in Mundhwa and Bopodi to private parties.

In one of these controversial orders, Yewale had directed the Botanical Survey of India, which holds the land on lease until 2038, to vacate the property in favor of Amadea Enterprises LLP. Notably, Parth, the son of former deputy chief minister late Ajit Pawar, is another partner in Amadea Enterprises, though he has not been named in the First Information Report (FIR).

Key Accused and Chargesheet Details

Patil has been implicated in the case alongside Sheetal Tejwani, the power of attorney holder for the 272 Watandars—original holders of the Mahar Watan land before the system was abolished—as well as Yewale and six others linked to the Bopodi government land parcel order. The EOW filed an extensive 1,886-page chargesheet against Tejwani on January 27, adding depth to the investigation.

On February 18, Patil's lawyer, S S Kulkarni, submitted a pursis (information to the court) before additional sessions judge BV Wagh, explaining that the filing of the chargesheet against other co-accused necessitated a reconsideration of Patil's legal strategy. Kulkarni stated, "In view of the filing of the chargesheet, it became necessary for the applicant (Digvijay Patil) to reconsider, and amend the pleadings and grounds in light of the material contained in the chargesheet and accompanying documents."

Court Proceedings and Future Implications

The application further requested permission to withdraw the bail application with the liberty to file a fresh one if needed, after thoroughly examining the chargesheet and formulating appropriate grounds. The court allowed this plea, disposing of the application as withdrawn on these grounds. This move underscores the evolving nature of the case and the strategic legal maneuvers being employed by the accused.

The withdrawal of the anticipatory bail application marks a pivotal moment in the investigation, as it reflects the impact of the chargesheet on legal proceedings. It also highlights the broader implications for land deal cases in Pune, where government properties are allegedly being misappropriated through fraudulent means. The involvement of high-profile individuals and entities adds layers of complexity, making this a closely watched legal battle.

As the EOW continues its probe, further developments are expected to shed light on the extent of the alleged irregularities and the roles of various stakeholders. The case serves as a reminder of the importance of stringent oversight in land transactions to prevent such incidents in the future.
