Noida Juvenile Justice Board Delivers Landmark Verdict in 12-Year-Old Gang Rape Case
A Juvenile Justice Board (JJB) in Noida has handed down a significant verdict, sentencing two men to three years of reformative detention along with a fine of Rs 20,000 each for the gang rape and kidnapping of a minor that occurred twelve years ago. The board, emphasizing the gravity of the offense, directed that the convicts—now over 25 years old—serve their sentence in the district jail.
Case Details and Prolonged Legal Battle
The horrific incident dates back to January 5, 2014, when the two accused, who were 13 years old at the time, allegedly lured the 15-year-old survivor to a room in their building. According to the FIR lodged at Phase-II police station on January 21, 2014, the juveniles locked her inside, confined her, and took turns raping her while tying her hands and feet and turning up the TV volume to muffle her cries. They later threatened her with dire consequences if she disclosed the assault.
The case saw a protracted legal journey, with statements from nine witnesses, including the survivor's family members, recorded until May last year. Police had registered the case under sections of the Indian Penal Code related to kidnapping, gang rape, wrongful confinement, and criminal intimidation, along with provisions of the Protection of Children from Sexual Offences (POCSO) Act. A chargesheet was filed in March 2014, and since both accused were juveniles, the matter was transferred to the JJB.
Board's Reasoning and Sentencing
On Tuesday, a bench comprising Chief Magistrate Abhishek Kumar and members Arun Kumar Gupta and Mahendra Singh delivered the order, stating that the offense was grave and directly impacted women's safety. The board observed that granting probation would amount to injustice to the survivor, who, along with her working-class family, had pursued the case for over a decade. "Extending leniency would encourage such crimes," the board noted, highlighting the survivor's age of 15 at the time of the incident.
However, the JJB clarified that the conviction would not adversely affect the convicts' education, employment, and future prospects, balancing punitive measures with reformative intent. In its order, the board affirmed that the testimonies of the survivor and her father were consistent and credible, with the survivor's detailed account supported by surrounding circumstances, establishing guilt beyond a reasonable doubt.
Financial Compensation and Legal Implications
In addition to the jail term, the board ordered that 90% of the imposed fine be paid to the survivor within 30 days by the convicts' guardians. This decision underscores the board's focus on providing some measure of restitution to the victim, acknowledging the long-standing trauma endured by her and her family.
