Noida Consumer Court Orders Footwear Company to Refund Customer for Faulty Shoes

The District Consumer Disputes Redressal Commission in Noida has ruled against a footwear manufacturer. The commission ordered the company to refund a customer for two defective pairs of shoes. It also mandated compensation payments.

The panel found that Leayan Global Private Limited failed to provide basic after-sales service. This company manufactures Red Chief shoes from its base in Kanpur.

Court Directs Refund with Interest and Additional Penalties

On Monday, the consumer commission issued its final order. It directed Leayan Global to return Rs 6,262 to the complainant. This refund must include interest calculated at 6% per annum.

The company has thirty days from the order date to make this payment. Interest will be calculated from February 2025, when the complaint was originally filed.

The commission imposed further financial penalties. It ordered the company to pay Rs 500 as compensation for the customer's mental agony. An additional Rs 500 must be paid towards litigation costs.

Customer's Complaint Details Repeated Product Failures

Dhirendra Kumar, a resident of Bisrakh, filed the complaint with the forum. He told the commission he purchased two pairs of Red Chief shoes from an authorised outlet in Ghaziabad during 2024.

Kumar discovered both pairs suffered from significant defects. He bought the first pair on March 10, 2024, paying Rs 3,143.

Within just a few months, the shoes developed damage. This occurred despite the products remaining within their warranty period.

Kumar approached the seller first, then contacted the company directly. He alleged both entities denied his repair requests.

Company's Failed Promises Led to Second Purchase and Further Disappointment

After repeated follow-ups, a company representative finally collected the damaged shoes. This representative assured Kumar that a replacement would be issued directly from the company's headquarters.

Several months passed with no replacement provided. Frustrated by this extended delay, Kumar decided to purchase another pair of Red Chief shoes.

He bought the second pair for Rs 3,119. Unfortunately, he soon discovered what he described as a manufacturing defect in this pair as well.

This second failure prompted Kumar to approach the consumer forum formally. He sought a full refund and compensation for what he argued was a clear deficiency in service.

Commission's Ruling Based on Evidence and Company's Non-Response

The consumer commission issued legal notices to Leayan Global Private Limited. The company did not submit any response to these notices.

The commission bench, led by President Anil Kumar Pundir and including Member Anju Sharma, examined all documents submitted by the complainant.

After thorough examination, the bench concluded the first pair of shoes had failed within the guaranteed period. It also determined the second pair contained manufacturing defects.

The ruling emphasizes consumer protection rights and holds companies accountable for product quality and after-sales support.
