A court in Moodbidri has delivered a strong verdict in a distressing case of sexual harassment, convicting a footwear shop owner from Dakshina Kannada and sentencing him to rigorous imprisonment. The judgment underscores the legal consequences for crimes against women in India.

Court Delivers Verdict After Detailed Trial

On Tuesday, the court of senior civil judge and JMFC in Moodbidri pronounced the accused, shop owner Samshuddin, guilty of sexually harassing a woman customer. Judge Madhukara P Bhagawath sentenced him to three years of imprisonment and also imposed a monetary penalty. The court ordered Samshuddin to pay a fine of Rs 10,500 for his crimes.

Chilling Details of the 2021 Incident

The case dates back to December 12, 2021, when the victim visited Samshuddin's footwear shop in the Dakshina Kannada district to purchase slippers. Exploiting his position, the shop owner allegedly lured the woman into an inner compartment of the store under the false pretext of showing her footwear options. Once there, he touched her inappropriately and outraged her modesty, leading to immediate trauma and a fight for justice.

Showing immense courage, the victim approached the Mulki police station and filed a formal complaint. Based on her statement, the police registered a case under multiple sections of the Indian Penal Code (IPC).

Legal Process and Police Investigation

The case was registered under Sections 342 (punishment for wrongful confinement), 354(A) (punishment for sexual harassment), and 354(B) (assault or use of criminal force to a woman with intent to disrobe) of the IPC. The investigation was carried out under the guidance of the then police inspector, K Kusumadhara.

PSI Vinayak Toragal arrested the accused and filed the chargesheet, with valuable assistance from ASI Sanjeev AP. The thorough police work laid a solid foundation for the prosecution's case in court. Public prosecutor Nethravathi Kotian represented the state, arguing the case before Judge Bhagawath.
