Madras High Court Clarifies Scope of Equal Pay for Equal Work Principle

The Madras High Court has delivered a significant ruling, stating that the principle of equal pay for equal work is applicable only when employees are working within the same institution under identical service conditions. This clarification comes as the court emphasized that comparisons cannot be drawn between employees of public sector undertakings (PSUs) and those in government departments.

Court's Detailed Observations on Service Rules

A division bench comprising Justices S M Subramaniam and C Kumarappan made these observations while overturning a single-judge order. That order had directed the government to provide equal pay to a lineman employed by Arasu Rubber Corporation Limited, a Tamil Nadu government-owned PSU. The bench highlighted that since service rules are distinct and different between entities, the question of applying the equal pay principle does not arise at all.

The bench noted, "There cannot be any comparison in respect of employees working in public sector undertakings as well as government departments. Since service rules are different and distinct, the question of applying the principle of equal pay for equal work does not arise at all."

Financial Constraints and Government Directives

Further elaborating on the rationale behind the decision, the bench pointed out that government directives issued from 2010 onwards indicate that implementing revised pay scales for corporation employees on par with government employees should not be done routinely. Approval must be obtained from the government in such matters.

The court also considered financial aspects, stating that a PSU is fully funded by the government, and therefore, financial constraints must be taken into account by the government when making such decisions. This underscores the practical challenges in aligning pay structures across different types of institutions.

Core Principle Reiterated by the Court

Reiterating the core principle, the bench explained, "No doubt, equal pay for equal work was considered by the courts, but the principle would apply if the employees are working in the same institution and duties and responsibilities are the same. There cannot be any comparison in respect of the employees working in public sector undertakings as well as government departments."

This ruling serves as a clear guideline for future cases, emphasizing that the equal pay doctrine is context-specific and limited to homogeneous work environments within a single institution. It highlights the importance of considering institutional differences and service rules when evaluating pay equity claims.
