Madras High Court Mandates Removal of Traffic-Obstructing Arches in Madurai
In a significant ruling aimed at alleviating chronic traffic congestion, the Madras High Court has issued a directive to the Madurai Corporation and district administration authorities. The court has ordered the removal of the K K Nagar arch and other similar structures that hinder the free flow of traffic across Madurai district, setting a strict deadline of three months for compliance.
Background of the Public Interest Litigation
The court's decision came during the hearing of a public interest litigation (PIL) filed by M Saravanan, a resident of Madurai, in 2019. The petitioner highlighted that vehicular traffic in Madurai has increased dramatically over the past 15 years. This surge is attributed to the establishment and full-fledged operation of major commercial and public infrastructure, including markets, bus stands, industrial estates, and the High Court's Madurai bench.
Saravanan specifically pointed to a massive concrete arch located opposite the MGR bus stand in Mattuthavani. Erected during the 1981 World Tamil Conference, this arch occupies nearly 20 feet of the road, with vehicles often parked nearby, creating significant obstacles for both motorists and pedestrians. The petitioner also identified similar arches on the Therkuvasal-Madurai airport road in Villapuram and on the Madurai-Theni road in Virattipathu, all contributing to traffic congestion within the corporation limits.
Court Observations and Legal Reasoning
A division bench comprising Justice N Sathish Kumar and Justice M Jothiraman carefully examined the case. The judges observed that these arches were originally constructed to demarcate entry points into the city but have now outlived their purpose and become obsolete. Their presence, especially at high-traffic junctions, creates artificial bottlenecks, impedes vehicular movement, and violates road safety norms as prescribed by the Indian Roads Congress.
The bench noted the submission from the counsel representing the authorities, who stated that following an earlier court order in 2024, the arch opposite the MGR bus stand has already been removed. Additionally, the counsel informed the court that a tender has been floated for the removal of the K K Nagar arch, and this work is scheduled to be completed after the ongoing elections.

Based on these submissions and the evident traffic hazards, the judges directed the Madurai Corporation and district administration to ensure the removal of all identified arches within three months. The court emphasized the urgency of this action to improve road safety and traffic efficiency in the city.
