In a significant judicial reversal, the Madras High Court has sentenced nine individuals to life imprisonment for a murder that occurred in 2011, overturning their acquittal by a trial court eight years ago. The case, rooted in previous enmity in Tiruvannamalai, saw the High Court bench strongly criticize the lower court's handling of evidence.

Court Cites Strong Evidence in Overturning Acquittal

A division bench comprising Justice P Velmurugan and Justice M Jothiraman delivered the verdict on Wednesday, stating that all accused were present at the scene and participated in the attack that resulted in multiple injuries and ultimately caused the death of the victim. The bench emphasized that the prosecution had proven guilt beyond reasonable doubt through reliable witness testimonies and medical reports.

"The evidence of witnesses, together with the medical reports, is reliable and trustworthy," the bench noted in its judgment. "The trial court, however, failed to consider supporting medical evidence and gave undue importance to minor contradictions and the hostility of certain witnesses. The judgment of acquittal was therefore liable to be set aside."

Background of the 2011 Murder Case

According to prosecution details, the conflict originated from previous enmity between parties in Adaiyur village of Tiruvannamalai. On January 14, 2011, Elumalai was attacked and injured by certain individuals, leading to registered cases and counter-cases that escalated tensions.

The fatal incident occurred on April 25, 2011, around 5:30 PM, when Elumalai and his son Ramesh visited a shop in Tiruvannamalai Nagar. All nine accused, armed with deadly weapons and with common intention to murder Ramesh, confronted them. Upon seeing the accused, Elumalai and Ramesh attempted to escape but were chased down.

The accused then attacked Ramesh indiscriminately, causing grievous injuries. Ramesh was immediately taken to the Government Hospital in Tiruvannamalai, where he was declared dead upon arrival.

Legal Proceedings and Appeal

After completing the trial, the District and Sessions Judge in Tiruvannamalai acquitted all accused on December 21, 2017, ruling that the prosecution failed to prove charges beyond reasonable doubt. Dissatisfied with this outcome, the state filed an appeal, leading to the High Court's recent review and reversal.
