Jammu and Kashmir High Court Uncovers Alleged Criminal Network Targeting Vulnerable Girls
In a significant intervention, the Jammu and Kashmir High Court has initiated a comprehensive investigation into what appears to be a criminal network allegedly involved in luring young and vulnerable girls. This action stemmed from a routine protection petition filed by a 19-year-old woman and her much older husband, a moulvi, which initially seemed straightforward but quickly aroused judicial suspicion.
Court's Vigilance Prevents Potential Tragedy
Justice Rahul Bharti, who presided over the case, demonstrated remarkable vigilance during court proceedings. "A moment of vigilance on the part of this court, being able to prevent the life of a teenage girl from going to waste, is the best opening for this order," Justice Bharti stated emphatically. This observation came after the judge personally interacted with the bride, whose circumstances raised immediate red flags about her situation.
The government lawyer involved in the case revealed that following these interactions, the court took swift protective measures. The young bride was sent to the Open Shelter for Girls Home in Srinagar last week, while her husband was directed to Shaheed Gunj police station for detailed investigation. During this police inquiry, authorities made a crucial discovery: the man was already married, casting serious doubt on the legitimacy of his relationship with the teenager.
Court Takes Suo Motu Cognizance and Orders Multiple Investigations
During the second hearing of this case, the court made the significant decision to hand over custody of the teenager to her mother, ensuring her immediate safety. However, Justice Bharti made it clear that this was just the beginning of judicial scrutiny. "The proceedings of this case would continue suo motu before this court, particularly considering the fact that even the role of the advocate representing the petitioners needs to be seriously brought under scrutiny," the judge declared.
The court has directed multiple investigations into various aspects of this troubling case:
- The registrar Judicial in Srinagar has been instructed to issue a formal notice to the advocate who represented the petitioners
- A thorough probe has been ordered into the role of the moulvi, who allegedly facilitated the production of a nikahnama (marriage certificate) dated November 14, 2025, presented in court
- The court has appointed an amicus curiae to assist in examining broader issues related to the safety and security of young girls, with particular focus on vulnerable populations in rural areas
Enhanced Protection Measures and Special Investigation Team
Recognizing the seriousness of the situation, Justice Bharti has implemented additional protective measures. The Senior Superintendent of Police (SSP) has been directed to ensure the complete safety and security of both the young girl and her mother. Furthermore, the court has specifically requested the name of a woman IPS officer currently posted in Kashmir to lead the investigation into this case, ensuring gender-sensitive handling of what appears to be a pattern of exploitation targeting young women.
