Jaipur Court Acquits 10 Men in 26-Year-Old Malpura Communal Riot Case
A special court in Jaipur handling riot cases has acquitted 10 men in the 26-year-old Malpura communal riot case, delivering a verdict on Wednesday that cited a lack of credible evidence and granted the accused the benefit of doubt. The decision marks a significant development in a long-standing legal battle stemming from violence that erupted in July 2000.
Prosecution Fails to Prove Charges Beyond Reasonable Doubt
Special Judge Shewta Gupta, presiding over the case, ruled that the prosecution failed to substantiate charges of murder and attempted murder beyond a reasonable doubt. The court highlighted that the majority of witnesses had turned hostile during the trial, severely undermining the allegations against the accused.
"Majority of the witnesses in the case have turned hostile and it has certainly put a dent on the allegations levelled by the prosecution against the accused," the court stated in its judgment. This turn of events left the prosecution's case without crucial support, making it difficult to establish guilt.
Inconsistencies and Lack of Corroborative Evidence
The court also pointed to inconsistencies in witness testimonies and a lack of corroborative evidence directly linking the accused to the crimes. "The prosecution has failed to prove the charges with sufficient evidence," the judgment noted, emphasizing the legal principle that guilt must be proven conclusively.
Defence counsel Abdul Wahid Naqvi argued that the accused were falsely implicated, with police unable to provide concrete proof of their involvement. He further contended that no fresh evidence was produced against other accused whose investigations were pending, and claimed that alleged weapons had no blood traces, casting additional doubt on the prosecution's narrative.
Background of the Malpura Communal Violence
The case originates from communal violence in Malpura town, located in Tonk district, in July 2000. What began as a dispute escalated into a mob attack near a police station, resulting in four fatalities and multiple injuries. Complainant Manju Devi filed an FIR at Malpura Police Station, alleging that she and others were attacked while traveling in a jeep during the unrest.
This acquittal follows a similar ruling in February of this year, when the same court acquitted 14 people in a related case involving charges of murder, attempted murder, and rioting. The repeated acquittals highlight ongoing challenges in securing convictions in long-pending riot cases, often due to evidentiary issues and witness reliability.
