Delhi Court Grants Regular Bail to Couple in Racial Slur Case
A Delhi court has granted regular bail to a couple from Malviya Nagar who were accused of using racial slurs against individuals from Arunachal Pradesh and Manipur in February. The couple's 30-day interim bail had expired on Monday, prompting the court's decision on their regular bail plea.
Court Proceedings and Defense Arguments
Additional Sessions Judge Samar Vishal presided over the hearing where Harsh Priya Singh and Ruby Jain were produced before the court. The couple had initially been granted interim bail on March 11. Their legal team, comprising advocates Abinash Kumar, BP Singh, and Sumanta Barik, presented several arguments in favor of regular bail.
The defense emphasized that the accused had fully complied with all conditions set forth in the previous court order for interim bail. They provided evidence that Jain was undergoing continuous medication for tuberculosis, supported by hospital documentation. Furthermore, the defense argued that the couple had suffered significant reputational damage due to the case and had taken steps to make amends.
"They have apologized both publicly on social media platforms and personally to their victims in the presence of their landlord," the defense counsel stated during proceedings.
Prosecution Opposition and Victim Impact
Advocate Liyi Noshi, representing the prosecution, strongly opposed the bail plea, urging the court to send a clear message against racial discrimination. "A message is to be sent by not allowing such grave instances of racism to be taken lightly," Noshi argued before the court.
The prosecution highlighted the significant impact on the victims, noting that one had been forced to return to Manipur amid ongoing ethnic violence in the region. "It may have not caused them any physical injuries, but it did harm them in many other ways and cause them a significant loss of future opportunities," Noshi emphasized, detailing the emotional and psychological toll on the affected individuals.
Police Report and Investigation Status
The court had previously directed the police to file a status report regarding the conduct of the accused during their interim bail period. Police authorities informed the court that the couple had adhered to all conditions and had already shifted their residence from the location where the incident occurred.
After carefully reviewing the police status report and confirming the completion of the investigation, the court proceeded to grant regular bail to the accused couple. This decision came despite the prosecution's objections regarding the seriousness of the racial allegations.
Background of the Case
The couple was arrested on February 25 following allegations that they had hurled racial slurs at three women from Northeast Indian states. The dispute reportedly originated on February 20 when debris from an air conditioning installation fell onto the couple's residence below, sparking the confrontation that led to the racial remarks.
The case has drawn attention to issues of racial discrimination against people from India's northeastern states, who often face prejudice and stereotyping in other parts of the country. The court's decision to grant bail while acknowledging the completion of investigation marks a significant development in this legal proceeding.
