Calcutta HC Upholds Life Sentence in 2010 Political Murder, Says Witness Not on Trial
Calcutta HC Upholds Life Sentence in 2010 Political Murder

The Calcutta High Court on Thursday upheld the life sentence of two of the six convicts in a gruesome 2010 political murder, where a CPM worker was killed in front of his son in Katwa. The division bench of justices Rajasekhar Mantha and Rai Chattopadhyay held that the character of a witness is never a principal issue in a criminal trial — it is the accused who is on trial, not the witness.

Case Background

The incident occurred in 2010 in Katwa, where a CPM worker was brutally murdered in the presence of his son. The convicts were all Congress workers. The trial court had earlier sentenced six individuals to life imprisonment. However, one of the convicts died during the pendency of the appeal.

High Court Ruling

The division bench set aside the life sentence of the other four convicts, while upholding the sentence for two. The court emphasized that the credibility of a witness cannot be the central focus of a trial; rather, the guilt of the accused must be established beyond reasonable doubt.
