Police in Uttar Pradesh's Rae Bareli have taken legal action against medical professionals following the tragic death of a young man after a surgical procedure. An FIR was registered on Saturday against two doctors and the manager of a private hospital, accusing them of medical negligence which allegedly led to the patient's demise.

Allegations of Unauthorized Surgery and Misleading Information

According to the complaint filed by Santosh Kumar Gupta at the Kotwali Nagar police station, his 22-year-old son, Deepak Gupta, was suffering from kidney stones. The family alleges that hospital manager Ajay Yadav misled them and brought Deepak to the hospital on December 14. Initially, the doctors reportedly stated that surgery was required only in one kidney. However, in a shocking turn of events during the operation conducted late at night, both kidneys were allegedly operated upon without the family's consent.

Santosh Gupta claimed that his son's condition began deteriorating immediately after the surgery. Despite the family's repeated concerns and pleas, the doctors continued to assure them that the patient would recover. By December 16, Deepak's health had worsened significantly, prompting the family to demand his transfer to a hospital in Lucknow for better care.

Hospital's Resistance and Subsequent Death

The complainant further alleged that when the family insisted on moving Deepak to Lucknow, the hospital staff attempted to force them to take the patient to another hospital of their choice in Mohanlalganj. Defying this pressure, the family managed to shift Deepak to a private hospital in Lucknow. Tragically, doctors at this facility pronounced him dead upon arrival.

A post-mortem examination was conducted at King George's Medical University (KGMU) on December 17. However, the autopsy could not conclusively establish the exact cause of death, adding another layer of complexity to the case. Police are also investigating a viral audio clip in which a doctor is purportedly heard threatening the grieving family.

Legal Action and Police Investigation

Based on the detailed complaint, the police have registered a formal case against surgeon Dr Dharmveer Singh, private nursing home owner Dr RP Singh, and hospital manager Ajay Yadav. The FIR has been lodged under several sections of the newly implemented Bharatiya Nyaya Sanhita (BNS), including:

  • Section 106(1) for causing death by negligence.
  • Section 131 for criminal intimidation.
  • Section 352 for intentional insult with intent to provoke breach of peace.

Additional Superintendent of Police, Rae Bareli, Sanjeev Sinha, confirmed the registration of the FIR. He stated that further legal proceedings would depend on the evidence gathered during the ongoing investigation. The complainant has demanded strict legal action against the accused, including the seizure of the hospital, holding them accountable for what he describes as "gross medical negligence and exploitation."

This incident has raised serious questions about patient consent protocols and accountability in private healthcare facilities. The police probe will now focus on verifying the allegations, examining medical records, and analyzing the controversial audio clip to determine the course of events that led to the young man's untimely death.
