Steven Tyler has achieved a significant legal victory in the ongoing lawsuit that accuses him of sexual assault of a minor. A California judge dismissed the majority of claims brought against the Aerosmith frontman, allowing only one claim to proceed.
Background of the Lawsuit
Julia Holcomb, the plaintiff, alleges that she was involved in a years-long relationship with Tyler that began when she was just 16 years old. Holcomb filed the lawsuit in California, making several claims about sexual encounters that allegedly occurred in various states.
Court Ruling
According to court documents cited by TMZ, the judge dismissed all claims except one. The sole remaining claim is linked to an alleged incident in California in 1974. This claim centers on an allegation that Tyler and Holcomb had sexual relations during a trip to California, including at a hotel and a public hot tub, when she was still a minor.
Tyler's attorney, David Long-Daniels, issued a statement celebrating the ruling. He said, "This is a massive win for Steven Tyler. Today, the court has dismissed with prejudice 99.9% of the claims against Mr. Tyler in this case. The court has decided that only one night fifty-plus years ago out of a three-year relationship is allowed to remain. We look forward to trying this case on August 31."
Dismissed Claims
Claims related to alleged sexual encounters in other states, including Massachusetts and Oregon, were dismissed on jurisdictional grounds. These claims cannot be tried in a California court. Court filings indicate that the couple's relationship continued for several years. By June 1975, the two were reportedly living together, engaged, and even expecting a child.
Legal Proceedings
Holcomb initially filed the lawsuit in December 2022, accusing Tyler of sexual assault, sexual battery, and intentional infliction of emotional distress. The case is now set to proceed on the single remaining claim.
Tyler's Health Concerns
Last year, Aerosmith canceled the rest of their AeroVederci tour, sparking concern over Tyler's health. In a statement posted on the band's official website, Tyler wrote, "I give you all an A+ for creative speculations but I certainly did not have a heart attack or a seizure (unless Joe Perry is taking' a ripping' lead). Sorry to have cut the tour short but I had to have a procedure that only my doc in the States could perform."
He added, "It breaks my heart to have left this tour early. The band has never played better. Just watch the 100,000 people at Rock in Rio. We've been to Tel Aviv...to Russia... to Rio... and all the in between... I guess it's true what they say, 'That life's a pisser when eu're a peeing'."
