The legal intervention came at the behest of Aamir Khan Films, the production house led by actor-producer Aamir Khan, which moved the court fearing potential illegal online circulation of the film.
Court Issues Ad-Interim Injunction Against Unauthorised Distribution
Justice Senthilkumar Ramamoorthy of the Madras High Court passed an ad-interim injunction order, effectively restraining any unauthorised broadcast, transmission, or distribution of the film until the court provides further directions. The case was registered as Aamir Khan Productions vs BSNL.
In his observations, Justice Ramamoorthy acknowledged the heightened vulnerability of films to leaks in the digital age. The court noted that any premature, illegal release ahead of the official date could cause "irreversible injury" to the producers, potentially devastating the commercial prospects of the project.
Balancing Act: Injunction and Indemnity
Recognising that the broad injunction could inadvertently affect the lawful commercial interests of some parties, the judge also included a protective measure. The court directed the film's producers to furnish an indemnity in favour of those respondents who might suffer legitimate losses due to the order. This clause aims to balance the urgent need for copyright protection with the rights of innocent third parties.
