The theatrical release of actor Vijay's highly anticipated film, 'Jana Nayagan', scheduled for January 9, faces significant uncertainty. This follows a Madras High Court hearing on Monday, January 5, which failed to resolve a legal petition concerning the delay in granting the film's censor certificate.

Producers Argue All CBFC Objections Met, Delay Called 'Administrative'

During the hearing, the counsel representing the film's producers, KVN Productions, presented a strong case. They asserted that 'Jana Nayagan' is fully eligible for a U/A certificate and that all creative objections raised by the Central Board of Film Certification (CBFC) had been satisfactorily addressed. The court was informed that the film has already received certification in 25 other countries.

The legal team emphasized that the producers had complied with all suggested edits from the board. They argued that the holdup is not due to any content issue but is purely an administrative delay in the final issuance of the certificate. The counsel stated that no further creative or legal shortcomings remain to be rectified.

Court Questions CBFC Procedure, Seeks Formal Complaint

The petition raised serious questions about the CBFC's internal procedures. It was argued that board members had initially viewed and were satisfied with the film. However, a decision to reconsider the certification was allegedly taken later based on input from an individual who had not even watched 'Jana Nayagan'.

The producers' counsel contended that such a reconsideration must follow a formal procedure and be referred to a revising committee, as it effectively constitutes an appeal. Despite this, the CBFC chairperson passed an order on December 22, after which the producers were told they could approach the revising committee if dissatisfied.

In a significant development, the Madras High Court has now directed that a complaint alleging hurt religious sentiments be formally filed. Only after this filing will the matter be examined further, as reported by Sun News.

Release Date Flexibility Discussed as Hearing Adjourned

The court also deliberated on the urgency of the January 9 release date. Justice B.D. Asha questioned whether the film could instead be released on January 10, philosophically remarking that "when Thai is born, a way will be found."

With these observations, the court did not conclude the hearing and adjourned the case to Tuesday, January 7, for further proceedings. This postponement leaves the film's release plans under a cloud, with fans and the film industry anxiously awaiting a final verdict.

The outcome of tomorrow's hearing will be crucial in determining whether 'Jana Nayagan' can meet its planned release schedule or face a postponement.
